On the regulatory side, the labor code requires ensuring the safety and protection of their teams. “The case law has been clear since 2015: it is not an obligation of result but an obligation of means. The employer must do prevention, to guarantee the employee that his health will not be affected in the workplace, ” explains Matthieu Babin, associate lawyer at Capstan.
