The guarantee of products and services that expire during the period of Social, Preventive and Mandatory Isolation will be extended until the quarantine ends. The Government, through the Ministry of Internal Trade, extended the terms provided for in the "contractual and legal" guarantees because consumers cannot "exercise their rights during that period."
The Consumer Defense Law provides - Article 16 of Law 24,240 - that the time during which the consumer is deprived of making use of the guarantee of the good or service purchased, must be computed as an extension of the legal guarantee period . For this reason, and given the evolution of the epidemiological situation, the Secretary of Commerce made the decision to extend the guarantees.
Based on this resolution (244/2020), published this Wednesday in the Official Gazette, the suppliers of goods and services must inform in a certain, clear and detailed manner the suspension of guarantee periods and in the event that they have websites or applications for mobile devices, this information must be visible on the home page or screen, respectively. Likewise, they must inform consumers of said suspension in the step immediately prior to payment.
The Consumer Protection Law establishes that all products have a legal guarantee. In the case of new products, the minimum guarantee is 6 months . If the products purchased are used, the minimum warranty is 3 months. Additionally, providers can offer terms longer than those stipulated by the standard, but never shorter.
