Giovanni Canio Mazzaro is accused of fraudulent theft of assets and false declaration of income. The matter at the center of the trial concerns the sale of the 'Unica' yacht which took place on 1 April 2019.

For the defense, however, there is a lack of evidence and therefore an acquittal was requested "because the fact does not exist," says the defense lawyer. The entrepreneur allegedly evaded taxes in 2013 by transferring, "on the basis of reversibility agreements," his income as director of Bioera spa and Ki Group spa to M Consulting, an interposed company, in order to indicate in the tax return an amount lower than that received. He would have accumulated a debt towards the Treasury of approximately 1.5 million euros in total, according to the indictment. But to "avoid paying taxes (...) and make the tax collection procedure ineffective," on April 1st 2019, he allegedly simulated the sale to Biofood Italia srl, at the time represented by his ex-wife Santanche.
