The 'malus' arrives in the family car RC which, extended to different vehicles (cars / motorbikes) and also to the renewals of policies, provided only for the 'bonus' mechanism. In practice, in the event that the beneficiary of the family contract with a vehicle of different types (presumably motorbike or motorbike) causes an accident with damages in excess of € 5,000, he may undergo a subsequent downgrade of 5 on the subsequent stipulation - only he and not the other family members - merit classes . The novelty is contained in an amendment to the Milleproroghe decree of the dem Claudio Mancini, reformulated by the Mise.
"Upon the occurrence of an accident in which a driver placed in the most favorable class of merit for the vehicle of different types and who has entailed the payment of compensation in excess of five thousand euros, has been exclusively or principally responsible, - reads in the amendment - the insurance companies, on the first subsequent expiry of the contract, can assign, for the only vehicle of different types involved in the accident, a class of merit up to five units higher than the criteria indicated by IVASS ".
The provisions, it is still clarified, "only apply to the beneficiaries of the assignment of the most favorable class of merit for the vehicle of different types only". The first version of the Mancini amendment, which also contained a postponement of the entry into force of the system (proposal also presented by M5S, Iv and FI), provided that the malus was familiar, as well as the bonus, and that the penalty after the the accident therefore concerned all the insured within the same group.
The reformulation desired by the Ministry of Development not only makes the postponement disappear but instead focuses on the individual malus. In this way, however, virtuous behavior is encouraged which would have been lost with the entry into force of the new system as introduced by the tax decree.
THE REACTIONS : "The loss of 5 classes of merit appears to be an excessive punitive measure, which risks benefiting only the insurance companies by damaging motorists - explains the president of Codacons, Carlo Rienzi - Such a strong downgrading would effectively cancel the economic savings for families, which are then at the basis of the rule on family car insurance: we would have expected amendments to prevent insurance companies from increasing tariffs, given that the first news of increases in policies already circulating aimed at recovering the lower earnings determined by the regulation which will start on February 16, "concludes Rienzi.
"Ania reiterates that the new provision on Motor TPL definitively undermines the bonus / malus system and, by not activating any intervention on the overall charges, it only operates a redistribution of accident costs with a decrease in prices in favor of families who have more vehicles, to the detriment of those that have only one. " Ania herself says so in a note.
