NRW: Schoolchildren fail with an urgent application against mask requirement in class

Three students in North Rhine-Westphalia doubted the benefit of mouth and nose protection in fighting pandemics - and therefore sued against the requirement to wear a mask in class. Vain.

In North Rhine-Westphalia the mask requirement remains in the classroom at secondary schools. The Higher Administrative Court rejected an urgent application from three students. The judges in Münster decided that the temporary obligation to always wear a mouth and nose covering in the classroom was proportionate.

It is also not evident that wearing them poses health risks for the students. According to scientific findings, the mask requirement in class is also suitable for curbing the spread of viruses. In this way, you contribute to avoiding further school closings. This is exactly what the three plaintiffs from the Euskirchen district had expressed doubts. They take the position that the masks have not been scientifically proven to be useful.

To protect against corona infections, since the beginning of this school year, all students at secondary and vocational schools in North Rhine-Westphalia have had to wear mouth and nose protection in the classroom. Only elementary and special school pupils at the primary level are excluded. For everyone, however, a mask is required on the school premises and in the hallways.

Court argues with mask breaks

North Rhine-Westphalia thus has the strictest mask requirement in schools nationwide. In other federal states it only applies in hallways and on stairs, in some also in the playground. In contrast, some federal states leave the decision to the school management.

Schleswig-Holstein had turned around on Wednesday and had switched from an "urgent recommendation" to a mandatory mask requirement. The decisive factor was a court ruling in which a student from Kiel initially successfully defended himself against a special requirement from his school to wear a mask in class. The legal situation here was different from the case in North Rhine-Westphalia.

In its decision, the Higher Administrative Court in Münster pointed out that the masks can be removed from time to time in class if this appears necessary for educational reasons. In addition, the school administrators could grant exemptions from the mask requirement for medical reasons.
