Those who choose their wedding date usually think least about their employer.

Nevertheless, the question arises: Are employees entitled to a day off?

The wedding * is usually a very special day in life.

The weekend appointments at the registry offices in spring and summer are usually booked out well in advance.

So it may well be that the

wedding

date

falls

on a

weekday

.

Do employees then have the right to be given leave for their own wedding?

"This is not regulated in Germany by the Federal Vacation Act," explains Peter Meyer, specialist lawyer for labor law in Berlin and member of the executive committee of the labor law working group in the German Lawyers' Association (DAV).

The basis is Paragraph 616 in the German Civil Code (BGB).

"Basically it says: If an

employee is

temporarily prevented from doing his job for personal reasons, he still receives his remuneration for the downtime," explains the specialist lawyer.

“He

also doesn't have to rework

the lost

working hours

.” This applies, for example, when a family event is pending that requires your own presence.

"That is of course the case with your own wedding," says Meyer.

In addition, the

birth of a child

or

are personal reasons for which the employee is prevented from performing his work according to Section 616 BGB.

If collective bargaining agreements apply in companies, these provide for regularly paid special leave for those who are prevented from doing so, explains Meyer - accordingly also for one's own wedding.

If no collective agreement applies, the employer can, however, state in the employment contract that Section 616 BGB does not apply with the consequence that the remuneration continues to be paid.

“But even then the

employee

can of

course take part in his own wedding,” explains Meyer with a wink.

"Then the employee is entitled to unpaid special leave, which the employer cannot refuse either."

How long the employee

gets paid

for their own

wedding

is also variable.

"In some collective agreements there are up to three days of paid vacation for one's own wedding, other employers who do not have a

collective agreement

and paragraph 616 BGB is excluded say to their employees:" Take a day of unpaid vacation "," summarizes the specialist lawyer .
