Aix-Marseille: can the municipal police refuse to ticket open restaurants?

They got an extra 24 hours before the curtain came down and a closing time reduced to seven days instead of fourteen.

But these government concessions are far from calming the anger of local elected officials and restaurateurs in the Aix-Marseille metropolis.

Starting tomorrow, despite their protests, they will have to close their doors.

Except that "the city of Marseille will not provide its assistance to set up the closures," the deputy mayor warned Friday on social networks.

"The municipal police will not impose fines on open restaurants and bars," Samia Ghali insisted on BFMTV.

“The municipal police have other missions […].

I would prefer that tomorrow, the national police force be where it should be, where we have problems with wild rodeos […], the burglary problems, the narcotics problems, rather than going to ticket traders who try to earn a living and keep the French economy going, ”continued the elected official.

Can municipal police really not issue a ticket?

“The mayor is vested with general administrative police competence at the municipal level.

It is up to him to ensure local public order.

He is also in charge of police duties as a state agent.

Finally, he is a judicial police officer, ”noted a Senate report in 2010.

Appointed by the mayor, municipal police officers report to his authority.

“The municipal police depend on the mayor.

So they depend on how the town hall wants to use its police, towards what mission it wants to direct it, ”confirms the Parisian Yves Bergerat, president of the union of municipal police officers.

But in reality, the trade unionist is more circumspect.

"What is complicated is that the municipal police officers are above all investigative officers, they note offenses and this therefore poses a small problem on this point", he assures us.

In short, do not patrol in search of restaurateurs in violation, yes, but look away when the violation is noted, it is undoubtedly more complicated.
