Free state has to pay compensation for injured police officers on duty

A police officer from Bavaria was attacked and injured by a rioter during a deployment. But because he could not pay the compensation of 7,000 euros, the Free State has to step in.


The police officer was on duty at a quarry pond in Bavaria in 2017.

There he was attacked and injured by a riot.

The rioter was then sentenced to pay pain and suffering, but could not pay.

That's why the policeman asked for the money - 7,000 euros - from his employer, the Free State of Bavaria.

Now the administrative court has decided: The Free State has to pay the compensation for pain and suffering to the police officer.

The basis for the claim is a provision in accordance with Article 97 of the Bavarian Civil Service Act (BayBG) that came into force in 2015, according to which the employer must meet the injured civil servant's claim for compensation for pain and suffering in such cases.

However, the State Office for Finance did not want to pay because it considers the compensation for pain and suffering to be inappropriately high.

However, the office was not entitled to make this assessment, the administrative court has now decided.

"There is no competence of the employer to check the appropriateness of the claim for pain and suffering titled by the regional court or to question it," said a spokesman.

The Bavarian Ministry of the Interior did not comment on the specific case, but stressed that it was in favor of the regulation.

"The regulation is designed as a hardship regulation for exceptional circumstances in which civil servants have made a considerable special sacrifice for the general public," said a ministry spokesman.
