Police may reject applicants suspected of sexual assault

He had already been accepted: A 19-year-old successfully applied to the police. But then it came out that he should have sexually assaulted a woman. The police withdrew their promise - and rightly so.


The NRW police may reject an applicant if there are doubts about his or her personality.

The Aachen Administrative Court decided according to a statement.

Accordingly, a 19-year-old from the Heinsberg district had successfully applied for the high-level police force.

He should start the service on September 1, 2020 and had already received the commitment in 2019.

In August of this year, however, the police learned that the public prosecutor was investigating the man for sexual assault.

The police then rejected his appointment, on the grounds that there were doubts about his suitability for the police force.

The man went to court.

"Justified Suspicion"

But the Aachen Chamber rejected his urgent application.

The decision of the police is not objectionable.

Due to the criminal complaint, the details of the alleged victim and a witness in the preliminary investigation, there is "at least the legitimate suspicion" that the 19-year-old is guilty.

If it turns out that the allegations are baseless, this should have an impact on the police's decision, the court said.

Due to the new situation, the authority is no longer bound by the commitment made in 2019.

The 19-year-old can appeal against the decision to the Higher Administrative Court in Münster.
