To protect against the corona virus, municipalities are allowed to exclude parents and witnesses from a wedding in the current shutdown.
The administrative court of Schleswig ruled that the local authority of the municipality covers such an exclusion of persons who are not required for the marriage.
A bridal couple who had only heard of the regulation the day before the wedding, said a spokesman for SPIEGEL, had sued in an urgent procedure.
According to a statement from the court, the judges refused to oblige the community of Rellingen in Schleswig-Holstein to admit parents and witnesses to the wedding ceremony (Az .: 3 B 132/20).
The local registrars had decided, in coordination with the mayor, to only allow the legally required group of people to marry in November.
This serves to reduce contact.
The court came to the conclusion that this practice was not objectionable.
The local authority of the municipality includes in particular measures to ensure the safety of employees and visitors.
The community also does not violate the basic protection of marriage, it said.
Marriages would continue.
The administrative court ruled that the state's Corona regulation does not give rise to any entitlement to admission of parents and witnesses.
This only contains minimum requirements for infection protection.
In individual cases - as in this case by the municipality - authorities could take further measures within the framework of house rules.
A complaint against the decision can be submitted to the Higher Administrative Court within two weeks.
