Housing Minister Emmanuelle Wargon announced this week on RTL that the state, via the prefect, will replace the mayors of cities who refuse to build low-cost housing.

Yes, the law authorizes the prefect to issue the HLM building permit himself in the event of a deficiency, but the idea is not new.

It had been announced in 2015 under François Hollande.

Problem: until the end of 2016, the State could not act in this way only for towns that do not have a local urban plan (article L 422-1 of the Town planning code).

Since December 22, 2016 and the adoption of the Equality and Citizenship law, this is now the case for all municipalities.
