A study reveals that Bolsonaro led an "institutional strategy to spread the virus"

After analyzing 3,049 federal regulations created in 2020, the Faculty of Public Health of the University of São Paulo and the NGO Conectas Human Rights demonstrate why Brazil exceeds 212,000 deaths from covid-19


The most macabre timeline in the history of public health in Brazil emerges from the study of the regulations created by the Government of Jair Messias Bolsonaro in relation to the covid-19 pandemic.

Since March 2020, the Center for Research and Studies on Health Law of the School of Public Health of the University of São Paulo (USP) and Conectas Human Rights, one of the most respected justice organizations in Latin America, have compiled and broken down the federal and state regulations regarding the coronavirus and have produced a newsletter called

Rights in the pandemic: mapping and analysis of the legal regulations that respond to covid-19 in Brazil

.

This week, they launch a special edition in which they affirm: "our study has revealed the existence of an institutional strategy for the spread of the virus, promoted by the Brazilian Government led by the President of the Republic."

THE COUNTRY has had exclusive access to the analysis of ordinances, provisional measures, resolutions, normative instructions, laws, decisions and decrees of the Federal Government, which, together with the compilation of the president's public statements, draw the map that has converted Brazil is one of the countries most affected by covid-19 and, unlike other nations in the world, still does not have a vaccination campaign with a reliable schedule.

It is not possible to measure how many of the more than 212,000 Brazilian deaths could have been avoided if, led by Bolsonaro, the government had not carried out a project to spread the virus.

But it is reasonable to say that many people would have their mothers, fathers, brothers and children alive today if there were no institutional project of the Brazilian Government to spread covid-19.

There is intention, there is a plan and there is systematic action in government regulations and in Bolsonaro's statements, according to the study.

“The results dispel the persistent interpretation that part of the federal government is incompetent and negligent when it comes to managing the pandemic.

On the contrary, the systematization of the data, although incomplete due to the lack of space in the publication for so many events, reveals the commitment and effectiveness of the federal government's action to widely spread the virus in the national territory, declared with the objective to resume economic activity as soon as possible and at any price, ”says the publication's editorial.

"We hope that this timeline offers a global vision of a process that we live in a fragmented and often confused way."

The study is coordinated by Deisy Ventura, one of the most respected jurists in Brazil, who investigates the relationship between pandemics and international law and is coordinator of the doctorate in Global Health and Sustainability at USP;

Fernando Aith, professor of the Department and Policy, Management and Health of the Faculty of Public Health of USP and director of CEPEDISA / USP, a pioneering center in research on health law in Brazil;

Camila Lissa Asano, program coordinator for Conectas Human Rights;

and Rossana Rocha Reis, professor in the Department of Political Sciences and the Institute of International Relations of USP.

The timeline is made up of three axes presented in chronological order, from March 2020 to the first 16 days of January 2021: 1) normative acts of the federal government, which include the edition of norms by federal authorities and bodies and the presidential vetoes;

2) acts of obstruction to the responses of state and municipal governments to the pandemic;

and 3) propaganda against public health, defined as “the political discourse that mobilizes economic, ideological and moral arguments, in addition to false news and technical information not scientifically proven, with the purpose of discrediting the health authorities, weakening popular adherence to health recommendations based on scientific evidence and promote political activism against the public health measures necessary to contain the advance of covid-19 ”.

The authors point out that the publication does not present all the norms and statements collected and stored in the research database, but rather a selection that seeks to avoid repetition and present the most relevant for the analysis.

The data was collected from the database of the Rights in the pandemic project, from the jurisprudence of the Federal Supreme Court and the Union Court of Accounts, as well as other official documents and speeches.

In the axis that they define as propaganda, the Google search engine was also used to collect videos, publications on social networks and news.

The analysis shows that "most deaths would be preventable through a disease containment strategy, which constitutes an unprecedented violation of the right to life and the right to health of Brazilians."

And this has occurred “without the managers involved being held responsible, despite the fact that institutions such as the Federal Supreme Court and the Union Court of Accounts have pointed out, countless times, the disagreement with the Brazilian legal system of conscious conduct and omissions and volunteers from federal managers ”.

They also highlight "the urgency of discussing in depth that they represent crimes against public health, crimes of responsibility and crimes against humanity during the covid-19 pandemic in Brazil."

Bolsonaro's acts and speeches are known, but they end up being diluted on a day-to-day basis, fueled by the production of factoids and fake news, in which the hate war is also a strategy to cover up the consistency and persistence of the project, which is advancing while the temperature remains high on social media.

The publication causes shock and discomfort by systematizing the explicit production of evils that Bolsonaro and his Government have put into practice during almost a year of pandemic.

One of the main merits of the study is precisely to articulate the different official measures and the president's public speeches on the timeline.

From this meticulous analysis the plan arises, with all its phases duly documented.

It is also made explicit against which populations the attacks are concentrated.

In addition to the indigenous peoples, whom Bolsonaro denies even drinking water, there are a series of measures adopted to prevent workers from being able to protect themselves from COVID-19 and isolate themselves.

The Government extends the concept of essential activities even to beauty salons and seeks that several unions have their right to emergency aid of 600 reais ($ 110) determined by Congress canceled.

At the same time, it seeks to implement double standards for health professionals: Bolsonaro vetoes the entire project that provides financial compensation for those workers who are disabled as a result of their actions to contain the pandemic and tries to exempt officials from any responsibility for acts and omissions in the fight against covid-19.

In short: hard and risky work to prevent and fight a pandemic is discouraged and omission is encouraged.

By withholding resources earmarked for covid-19, the Government impairs care for the sick in state and municipal public health systems.

The war against governors and mayors trying to implement measures to prevent the spread of the virus is constant.

The list is long.

Through vetoes, Bolsonaro cancels even the most basic measures, such as the obligation to wear a mask in establishments that are authorized to operate.

Many of his measures and vetoes are later annulled by the Federal Supreme Court or the Legislative itself.

This is another important point: the analysis of the data also shows to what extent the situation in Brazil could be even more tragic if the Supreme Federal Court and other instances had not stopped several of the measures to spread the virus that the Government created.

Despite the fragility that institutions and society have shown, the effort on the part of the protagonists to try to annul or neutralize Bolsonaro's actions is visible.

It is possible to do the exercise of projecting how much all these efforts, combined and associated with a government willing to prevent the disease and fight against the virus, could have made to avoid deaths in a country that has a large public health system.

Instead, Bolsonaro produced a war in which most of the energy of institutions and organized society was dissipated to reduce the damage his actions produced, instead of focusing on the fight against the biggest health crisis in a century. .

Almost a year after the first case of covid-19 emerged in Brazil, it remains to be seen whether society and institutions that are not accomplices of Bolsonaro will be strong enough to, in the face of the map of institutional actions for the spread of the virus, stop finally to the agents of dissemination of the disease.

Bolsonaro dismisses the Minister of Health during the pandemic.

Bolsonaro uses decrees to boycott the determinations that the states and mayors have taken to prevent the spread of covid-19.
