Bonafede, Recovery funds linked to justice reforms

Report on the state of justice that Minister Alfonso Bonafede sent to the Chambers yesterday evening.

REFORMS AND RECOVERY

- "The confidence of the European institutions towards the prospects for relaunching our country is therefore strongly conditioned by the approval of effective reforms and investments in the justice sector", Bonafede emphasizes.

"Moreover, it cannot escape as any investment project - even if it is not strictly understood in the justice sector - to be deemed credible it must be immune from the risk that a long legal dispute hinders its realization within the deadlines established by the Next Generation EU Regulation", the minister continues, recalling that "the reform projects of the criminal trial, the civil trial and the judicial system, approved by the Council of Ministers in 2019 and 2020, are currently being examined by Parliament". measures developed before the pandemic, the economic and social crisis that ensued and, therefore, before the prospects for recovery embodied by the Next Generation EU were opened ".

"Of the approximately 3 billion euros allocated by the draft PNRR sent to the Parliament to the justice sector,

2.3 billion are destined for fixed-term recruitment, largely dedicated to strengthening and requalifying the Office for the trial

Office that "can now be fed by

16,000 employees with fixed-term contracts and by 2,000 aggregate honorary magistrates

. Minister Bonafede stresses this again, in the report in which he explains that the objective is" to absorb, within the foreseen horizon (2026), the backlog, which is the main factor slowing down the processes and the practical obstacle to the implementation of the right to a reasonable duration ". Another

4,200 temporary workers

will be called upon to strengthen the administrative capacity of the system. And a contingent of 100 honorary magistrates auxiliaries will support the tax section of the Court of Cassation, "which is burdened by a number of pending cases greater than the global figure of all the other civil sections of the Court of legitimacy".

PROCEDURES IN PROGRESS

- Over the last year the total number of

criminal proceedings pending at the judicial offices has remained stable, standing at 2,676,750

proceedings as of September 30, 2020. The data is also contained in the Report of the Keeper of the Seals.

In the first nine months of 2020, in connection with the slowdown in activities due to the pandemic,

the total number of criminal proceedings pending in the courts increased by 4.3%

.

In the same period, however,

the number of proceedings pending before the prosecuting offices decreased (-2.7%)

.

Compared to the previous year, a generalized

decrease in the number of new registrations (-11.71% of the total), corresponds to an equally general decrease in definitions (equal to -16.40%)

.

Overall, there was an increase in slopes equal to 1.51%.

- ATTORNEYS - As regards the Prosecutors, the trend of definitions, strongly influenced by the pandemic situation, shows a generalized reduction equal, respectively, to 17.59% for crimes under the responsibility of the DDA, to 10.74% for ordinary crimes and 17.29% for crimes under the jurisdiction of the justice of the peace

- COURT - For the Court offices, overall, the judicial year 2019/2020, compared to the previous one, shows a decrease in registrations (down by 14.35%) and definitions (down by 19.43%)

.

- COURT OF CASSATION - The same goes for the Court of Cassation

(decreased inscriptions and definitions, respectively by 18.62% and 28.78%).

And for

the Courts of Appeal: 

a decrease in enrollments equal to 15.79% corresponds to a reduction in definitions of 25.08%.

- PRISONS

 - As of 31 December 2020, there were 53,364 inmates in prisons,

over 7,000 fewer than the previous year (60,769)

. Compared to the totality of the prison population, the

foreigners are 17,344

, the

51,109 men

, the

2,255 women

. The

definitively convicted are 36,183

, the

inmates awaiting trial are 8,655

, the appellants 4,078 and the plaintiffs 3,065. There are three internees.
