Obligation to indicate on the products the purpose of the proceeds and the recipient of the charity, the amount or share intended for that purpose, and sanctions from 5 thousand to 50 thousand euros, with the possibility of suspension of the activity for one year in case of repeated violations : this is foreseen in the draft of the bill on transparency on the charitable use of proceeds deriving from the sale of products, expected tomorrow on the table of the preparatory meeting of the Council of Ministers on Thursday.
The Antitrust Authority is responsible for imposing sanctions.
There is also the obligation, before placing the products on the market, to indicate to the Authority that mandatory information, as well as the deadline within which the amount intended for charity will be paid.
Within three months of that deadline the producer must notify the Authority of the payment.
"In less serious cases - it is foreseen in the draft - the sanction is reduced by up to two thirds. In case of repetition of the violation, the suspension of the activity is ordered for a period of from one month to one year".
Influencers who violate the rules on transparency in the sales of products for charitable purposes will have to publish the sanction they receive on their website.
This is foreseen in the draft of the bill being examined tomorrow at the preparatory meeting of the Council of Ministers, expected on Thursday.
The Antitrust, it is written in the draft, "publishes, also in extract, the sanctioning measures adopted on a specific section of its institutional website, on the website of the producer or professional recipient of the sanction, in one or more newspapers, as well as through any other means deemed appropriate in relation to the need to fully inform consumers at the care and expense of the producer or professional".
The amount of the administrative fine from 5 thousand to 50 thousand euros "is determined, in each individual case, by referring to the list price of each product and the number of units offered for sale".
