“We will create a new federal criminal jurisdiction that will unify criminal jurisdictions that today have jurisdiction in the area of the Autonomous City of Buenos Aires,” said President Alberto Fernández announcing the judicial reform that his government will undertake. His message was structured in a strong criticism of Justice and more directly, to the federal jurisdiction that resides in Comodoro Py. He criticized the "oligopoly of the judges", spoke of "manipulative" justice, of handling in the draws of the causes. His eyes are on Comodoro Py, where there are key positions to be filled: courts, positions in the Federal Chamber and in the Oral Courts.
The president promised “half a hundred courts” to judge corruption, for which he will add to the twelve courts of Comodoro Py part of the Buenos Aires national criminal courts, while another portion will be transferred to the City. As interpreted, Alberto seeks that with more judges there is less policy in those key offices
The announcements had an impact on the judicial environment when, even before the avalanche of new judges envisaged by the reform, there are at least half a dozen key positions in the Federal Retirement Courts to fill . Although Alberto Fernández promised that there will be no appointments of "friendly judges", many of those positions still have causes that are sensitive to Kirchnerism.
Of the twelve courts of instruction, three must be covered. The first one left vacant is Sergio Torres, who joined the Buenos Aires Court and is being replaced by Judge Rodolfo Canicoba Corral. In turn, this magistrate in June turns 75 and it is not ruled out that he decides to leave justice if the magistrates' retirement system is modified. That would generate another armchair to cover.
Who already exceeded that age but remains in his office thanks to an amparo is María Servini, responsible for federal court 1 with electoral competence. A key position
Federal court 11 became vacant after the death of Judge Claudio Bonadio. Marcelo Martínez De Giorgi is subrogating him in principle for a year.
The court of Daniel Rafecas would also be free, if the Senate votes for Alberto Fernández's proposal to make him Attorney General.
In the Buenos Aires Federal Chamber, responsible for reviewing the judgments of the judges, there are two vacancies in Room II, whose only member is Martín Irurzun, accused by Kirchnerism as the alleged intellectual author of the "arbitrary prisons" against former officials K.
The Oral Courts, in which acts of corruption are finally judged. for now there are eight. But only four have their three owners. The others have subrogated judges, while there are four open competitions to cover those charges. To this number must be added the recent resignation of two judges of the TOF 6, which judges Ricardo Jaime and Julio De Vido in acts of corruption. All these positions must be filled.
Another empty chair, still without judicial reform, is that of the prosecutor of the Buenos Aires Federal Chamber, which until December was in charge of Germán Moldes. After his resignation, the position is being subrogated by José Agüero Iturbe.
The map could change much more if, with the retirement reform, they chose to retire up to 150 judges, according to different estimates. Several of these withdrawals could occur in the federal jurisdiction of Buenos Aires.
While many magistrates suggested to Clarín that adding judges to the jurisdiction is not something unfavorable , there is still a lack of confidence regarding the “real motivation of the government to move forward with Justice, and if with the extension they do not seek to politicize the jurisdiction” rather than “clean it up” , said a magistrate with vast experience.
