The woman objected to this, but at the end of the trial she withdrew it again - without saying a word. Instead, the eight-year-old told what he remembered from that afternoon in mid-July last year. He threw sand at a boy. "I wanted to annoy him. But he also annoyed me and threw me with sand. That was mutual. Then the woman came and hit me, ”said the boy. "It was an argument between children that escalated," said one witness. The boy threw sand at the accused's grandson. "The woman said: Stop it! He threw again. ”Then the accused knocked him on the cheek with his open hand. "I said to her: This is not right what you are doing." Another witness, whose children also played in the playground, reported that she heard a clapping from her balcony on the second floor, like a flat hand that opened Skin beats ”.
When all the witnesses had been heard and judge Helmut Berger indicated that the testimony was sufficient for the conviction, the defense lawyer asked for an interruption. The conversation with his client in the courtroom resulted in the wish to be able to withdraw the appeal.
