Tutzing - Actually everything seemed clear: The "Tutzinger Hof" in Tutzing is closed due to Corona - but owner Petra Gsinn has a business closure insurance with Mannheimer Versicherung AG. In February it published information for insurance brokers on the Corona series, the "Brokers / News". There the crucial question is: "And who pays the breakdown, should the hotel be closed?" A business interruption insurance does not help here: "The solution instead is a business closure insurance (BSV)." Relief at the "Tutzinger Hof": " We were convinced that this is included in the insurance, ”says Petra Gsinn. She and her partner Rolf Läkamp calculated that they should have received 1562 euros per day from an officially ordered closure - for 30 days.

But then came a completely different message from Mannheimer Versicherung: Mannheimer only wants to pay 15 percent of the hoped-for insurance benefit. Petra Gsinn can not believe it: "We have an assurance that we will receive money in the event of an emergency and that we will not be in need of existence." Rolf Läkamp is also stunned: "We are totally disappointed."

Many restaurants and hotels have such business closure insurance policies. However, some insurance companies either completely refuse payments or only offer ten to 15 percent. Even these payments were only promised by the insurance industry with the intervention of the Bavarian Hotel and Restaurant Association (Dehoga Bayern), even with the involvement of the Bavarian Ministry of Economic Affairs. Reason: Because of support measures, emergency aid and saved expenses, the economic damage of a company is reduced by around 70 percent. The remaining 30 percent should share companies and insurers. According to the conditions, many insurers do not think they have to pay anything else.

An increasing number of insurers outside Bavaria are now following the “Bavarian solution”. Many restaurant and hotel operators are deeply disappointed. That is why the Hotel and Restaurant Association Bavaria (Dehoga) offers information talks with a specialized lawyer: Dr. Quirin Vergho. For days he has been bombarded with questions in video conferences. He has spoken to about 500 restaurateurs in the past two weeks, he estimates in conversation with the Starnberg Mercury. Vergho sees "dramatic differences". If the insurance terms state that the insurance applies "only to the following diseases" and Corona is not included, then this list is in many cases exhaustive. Then the company should accept the 10 to 15 percent - otherwise there may be nothing at all. However, if the conditions state that all notifiable illnesses mentioned in the respective version of the Infection Protection Act are insured, then this also applies to Corona.

In order to enforce this, however, policyholders should often need a lawyer. Problem: A lawsuit can take years. Many restaurateurs therefore associate hopes with class actions. This is also checked by Petra Gsinn.

And what do you say at Mannheimer Versicherung? They welcome the "Bavarian model," said press spokesman Roland Koch, although there is generally no insurance coverage for the corona pandemic. The Mannheim company is based on the Bavarian solution and extends the support of its customers to similar establishments such as cafés and ice cream parlors.
