New decrees in preparation to allow the “fortnight” when arriving in Overseas

The measure of "fortnight strict" for each person arriving in Overseas, undermined by the Constitutional Council, will be the subject of new decrees "in the coming days", announced Tuesday evening the Minister of Overseas Annick Girardin.

Since March 30, "in accordance with the recommendations of the scientific council, a strict fortnight was put in place on arrival in the territories," said the minister in a video Tuesday evening. This measure "proved essential" in the fight against the epidemic in Overseas, she says.

Censorship of the measure

But Monday, if the Constitutional Council validated the law extending until July 10 the state of health emergency and organizing deconfinement, it notably censored the measure establishing a strict fortnight for anyone arriving in Overseas.

He considered as "deprivation of liberty" measures that consisting of "complete isolation, which implies a ban on + any exit" or that which requires "the person concerned to remain at his home or place of accommodation during a time slot of more than twelve hours a day ". He therefore censored these measures, because they were not accompanied by guarantees "as to the obligations that may be imposed on persons subject to them, their maximum duration and the supervision of these measures by the court".

The Constitutional Council "confirmed that the principle of the fortnight is justified to protect our territories", explains Annick Girardin, but it also "considered that these fortnight must necessarily be accompanied by the guarantees which are now provided by law".

"The government will therefore be issuing decrees in the coming days to implement the quarantine measures provided for in the law of May 12," added the minister. Currently, for those in their fortnight, collective accommodation sites are open.

"The law does not question the measures already taken," said the minister. "All those who came overseas knowing the terms of the fortnight in the past two weeks remain in the places assigned to them by decree," said the minister.

On the other hand, "the new arrivals in the coming days will have to sign a contract of engagement to respect a strict fortnight on dedicated site or at their domicile", specifies Mrs. Girardin, who calls for "civility" of the ultramarins. "The principle of a ban on entry into the territories remains" and "only the compelling reasons for traveling, which are family, health or professional are justified," she adds.
