Telephone while driving: suspension at turn!

NEWS - Phone addicts behind the wheel have to behave well. By decree 2020-605 of May 18, 2020, the public authorities decided to punish its use more severely when another offense is committed simultaneously.


As of May 22, 2020, when the vehicle is intercepted and when an offense relating to the use of the handheld telephone (whether for a call, sending sms, or using social networks, etc. .) is established simultaneously with one of the offenses detailed below, the police forces may retain as a precaution the driver's driving license for a period of 72 hours.

During this 72-hour period during which the user is prohibited from driving, the Prefect may issue an order suspending the driver's license for a period of 6 months at most or 1 year in the event of an accident involving the traffic resulting in the death of a person or causing bodily harm.

The offender will also be fined for his or her offenses by means of a lump sum fine which he may later challenge before the police judge and will be penalized with the withdrawal of points.

What offenses committed simultaneously with the use of the telephone now expose the offender to the suspension of his driver's license?

1. The fact of not keeping your vehicle in normal operation near the right edge of the road;

2. Driving, in normal operation, on the left side of a two-way road;

3. The fact for the driver who is about to make a change in the direction of his vehicle or to slow down the pace of it not to warn of his intention the other users, in particular when he will go to the left, to cross the roadway, or when, after a stop or parking, he wants to resume his place in the flow of traffic;

4. Failure to respect the safety distances between vehicles;

5. Crossing or overlapping continuous line offenses;

6. Failure to comply with the absolute stop in front of a red, fixed or flashing traffic light, of a light reserved for cyclists or pedestrians;

7. Failure to comply with the stop of a fixed yellow signaling light;

8. Speeding offenses;

9. The fact, for any driver, of not remaining in control of his speed or of not reducing it with regard to the traffic circumstances;

10. Breaches of overtaking rules (ex: overtaking on the right, obstructing traffic coming in front, accelerating when one is about to be overtaken, ...);

11. Refusal of priority at stops and give way;

12. Refusal of priority for pedestrian crossing.
