Wolfratshausen - A woman from Wolfratshausen, who fell on the Schießstättstraße on September 12, 2019 with the e-bike of her boyfriend and husband of the time, had to dig deep into her pocket. Because the 41-year-old had previously been intoxicated in a restaurant and had massively resisted police officers after the accident in the district clinic, the district court sentenced her to a fine of 90 daily rates of 110 euros each.

Around 2.8 per thousand alcohol

The suspect still had around 2.8 per mille of alcohol in her blood an hour after the fall. "I don't remember that we had a higher value in negotiations this year," judged Helmut Berger. The petite woman said that, accompanied by her current husband, she had drunk three half beers and about five glasses of ouzo in a Greek restaurant within four hours. 

According to the assessment of an expert from a toxicological institute who was present at the trial, this amount is not enough to reach such a high alcohol level. "This suggests that you are getting used to alcohol," the expert suggested.

Head on the pavement

After visiting the restaurant, the couple temporarily separated. While the man was shopping for tobacco at a nearby petrol station, the woman wanted to take the e-bike to her apartment, which was about 500 meters away. "I took the bike between my legs to make it easier to push, and then I fell on the pavement with my head," she said.

Because the 41-year-old suffered a laceration, she was treated in the district clinic on the same evening. The police, who had informed a concerned local resident but no longer found the woman at the scene of the accident, encountered considerable resistance in the emergency room. "She insulted us with coarse swear words and resisted taking blood so much that we had to notify a second patrol," a 24-year-old policeman recalled the incident.

"I can't remember that at all," the defendant replied. Since she had been convicted of drunk driving and resistance to law enforcement officers almost three years ago, the prosecutor has now asked for a prison sentence, which could be suspended under long-term conditions.

Fine of 9900 euros

Lawyer Aglaia Muth, on the other hand, pleaded for her client's reduced liability and considered a fine to be sufficient. Judge Berger followed this request and fined the offenses with a fine of 9,900 euros. "I believe that you didn't push the bike, but drove it," the amateur cyclist explained his verdict.
