Take Ye Guoqian as an example. He is the current representative of the Minato People's Congress. He also participated in the two sessions in Beijing last week. When he attended the "Urban Forum" on Sunday (May 31), he responded to the accusation of subversion of the country for selling "remembering eight wine and six four" wine bottles in Sichuan last year. He believed that making wine bottles rather than words was an act. Ye Guoqian believes that the expression of "end the one-party dictatorship" is only an expression of the meeting of the support associations. However, if it is action or call to action, it will violate the National Security Law. However, Ye Guoqian did not say clearly the boundary between the nature of speech and call.

Tan Huizhu, a former deputy director of the Basic Law Committee of the Minato District People's Congress, was also repeatedly asked about the June 4th rally when he attended a radio program on Monday (June 1). Although he said that the "end of one-party dictatorship" is inconsistent with the political reality of China's multi-party cooperation, Tan Huizhu repeatedly said "no comment" or "don't know whether the chant of "end of one-party dictatorship" at the June 4th rally would violate the national security laws. "How to write the draft" and refused to answer.

Admittedly, the sale of merchandise for "redressing June 4th" and the slogan "Ending the One-Party Dictatorship", etc., may all commit crimes of subversion in the Mainland. However, the social situation in Hong Kong is different from that in the Mainland. It is not possible to apply a set of standards from the Mainland to Hong Kong. This also explains why the Mainland had a national security law in 2015, but it did not move to Hong Kong this time. Instead, the Standing Committee of the National People's Congress specially drafted the "Hong Kong version of the National Security Law." Ye Guoqian and Tan Huizhu, respectively, are deputies to the National People’s Congress of the Hong Kong District and deputy directors of the Basic Law Committee. They have a real responsibility to bring the differences between the "two systems" into discussion and put forward appropriate propositions so that this legislation can better cater to the needs of Hong Kong society. Zhiwu's right, or claim to "not comment", is not only irresponsible, but even unhelpful to "one country, two systems".

If it is said that Hong Kong’s failure to legislate for Article 23 is because Hong Kong people lack an understanding of “one country” in “one country, two systems,” then the “Hong Kong version of the National Security Law” is the “big test” for whether the central government accurately understands the “two systems”. Since there is anxiety in the Hong Kong society, the establishment faction should fully listen to and reflect public opinion, so that the society can relieve doubts, and assist the Standing Committee of the National People’s Congress to pass this test by drafting legislation that suits Hong Kong’s needs. They must raise their waists and strive to accommodate the differences between the "two systems" and strive for the greatest space for Hong Kong.

This is the central legislation. "Hong Kong 01" proposed five initiatives, including the Standing Committee of the National People's Congress consulting Hong Kong professional opinions, allowing the Attorney General and the Bar Association to fully reflect their opinions on Hong Kong's legal habits and social concerns, and assist the "Hong Kong version of the National Security Law" draft. The legislation should also be targeted and clearly specify the elements of crimes to avoid giving Hong Kong people a feeling of falling into the law.

The political elites of Hong Kong have not undertaken in the past 23 years, and they have no confidence in whether they can smoothly enact national security legislation based on "one country, two systems." Now that the Central Government has enacted the "Hong Kong version of the National Security Law" for Hong Kong, it is actually a "going to the examination" to test whether it still understands the differences and needs of the "two systems". In this historic examination, how much political elites with positions and powers can contribute not only to their personal reputation, but also to whether the "one country, two systems" can be stable and far-reaching. The formed faction should have such a high degree of self-awareness and historical cognition, and understand what they should do.
