The Quilmes Guarantees Justice ordered the preventive detention of Eliana Daniela Heidenreich (33), the agent of the Buenos Aires Penitentiary Service (SPB) accused of shooting the prisoner Federico Rey (23) to death during a riot in Florencio Varela Penal Unit 23 last April 22.

The magistrate in charge of the Court of Guarantees No. 8 of Quilmes, Adrian Marcelo Villagra, also ordered that the other two SPB officers suspected of covering up the crime be kept in jail : the mayor Gabriel Bergonzi and the deputy mayor Gastón Abila.

The news came out this Monday and, in the framework of the measure taken by Judge Villagra, the Mayor Warden Heidenreich will continue to be detained, accused of " homicide qualified for being a member of a security force and for the use of a firearm" by the prisoner Federico Rey.

Federico Rey (23), the prisoner who died in Unit 23 of Florencio Varela. The detainees reported that the guards killed him.

Judge Villagra is accused of Major Bergonzi and Subprefect Abila by the " aggravated cover-up " of the prisoner's murder.

In the 97-page ruling, the magistrate also ordered to deny the request for release due to lack of merit of the Bergonzi and Abila that their defense attorneys had requested.

In justifying the coercive measures dictated in the framework of the case and at the request of the prosecutor Roxana Giménez , the judge assessed in relation to Heidenreich that "the magnitude of the sentence in expectation that emerges in light of the reproached figure, is important enough to support, in particular, the idea of procedural danger. "

In addition, he took into account " the violence of the conduct displayed by the encartada, using weapons for greater intimidating power" and mentioned that at the time of the search and arrest warrant " he was not at home in violation of the DNU mandate No. 297/2020 "that imposes the mandatory isolation by the Covid-19.

On the two officers accused of cover-up, meanwhile, the judge considered that they should remain in preventive detention due to "the characteristics of the investigated event", and that having a hierarchical level in the force "there is a possibility" that they could " hinder the course of the process . "

Unit 23 of Florencio Varela, where Rey was assassinated.

The two penitentiaries were detained on April 28 last, while that same day but later Heidenreich turned himself in.

Rey was shot dead during a prison protest that took place on April 22 in the Florencio Varela prison, where there were 40 other prisoners and 15 slightly wounded officers, according to official reports.

The detainees demanded security and prevention measures in the face of the coronavirus pandemic.

After the investigation of the decentralized prosecutor's office No. 9 of Florencio Varela, in charge of the prosecutor Giménez, plus the information on Internal Affairs of the Buenos Aires Ministry of Justice and Human Rights, it was determined that the three had been involved in the crime.

Heidenreich is accused of being the one who shot Rey, and the other two penitentiaries, of having hidden or made to disappear the cartridges served as war posts (lead) fired at the victim.

Although the prisoner's death was initially attributed to a stabbing fight between inmates, the autopsy established that he had been shot to death with a 12/70 caliber shotgun when he was on the roof of Hall 6 of the Varela prison.
