Defendant Wu Wenhao (age 28), a trainee salesperson at Midland Realty Agency Ltd., was charged with two counts, namely one for obtaining property by deception, violating section 17(1) of the Theft Ordinance; and one for using false The instrument violates Article 73 of the Criminal Offences Ordinance.
The case alleges that from November 2016 to September 2017, the defendant was a trainee salesperson at a branch of Midland Realty Tuen Mun, but he was not a licensed real estate agent.
The defendant referred a customer introduced by his relatives to two licensed real estate agents of Midland Property in September 2017. About a month later, the customer bought a first-hand residential property unit in Tseung Kwan O for about 7.5 million yuan. Since the transaction involves a first-hand residential property, the commission due to Midland Property will be paid by the developer, and the customer does not have to pay any commission.
One of the charges was that the defendant was allegedly or dishonestly obtained about 75,000 yuan from the customer on October 12, 2017, with the intention of permanently depriving the customer of the property. The defendant allegedly falsely stated that Midland Property can receive a commission of approximately RMB 75,000 for the above property.
The other charge is that the defendant allegedly used a false document on October 29, 2017, that is, a provisional receipt that appeared to be issued by Midland Realty, with the intention of inducing the above customer to accept the true document.
The ICAC received a corruption complaint earlier, and after the investigation revealed the alleged crime. Midland Realty provided full assistance during the ICAC investigation of the case.
