Valley  - Because of dangerous bodily harm, a 28-year-old Afghan was now before the Miesbach District Court. According to the indictment, at around 10:10 a.m. in the Valley refugee accommodation in September 2019, during a clash between him and another resident with two security guards, he slapped one of the security guards, a 37-year-old Austrian, in the face. The second asylum seeker is said to have punched the second guard, a 31-year-old Geretsrieder, in the face, whereupon the guards fixed him on the floor. The Afghan is said to have hit the 37-year-old twice on the back of the head with the loudspeaker of a music system. The guard suffered a hematoma and abrasions.

The 28-year-old described the process from his perspective. He was cooking in the kitchen when the security guards asked him to leave. Then the argument broke out. He allegedly couldn't remember any details, only that the roommate had come in and had been fixed on the floor by the guards. As the reason for his incomplete memory, the man stated that he got drunk that night out of concern for his wife and the two daughters who were Greece to him. He has psychological problems against which he takes medication. Sometimes he couldn't remember what happened the night before. "I apologize, I'm sorry for what I did," he said.

The statements of the security staff were more detailed. Around 10 p.m. residents had heard music and drunk alcohol in front of the accommodation, the 37-year-old reported. They would have reacted aggressively to a warning. Finally, a police patrol had to keep calm. The situation in the home kitchen has escalated. Only residents who came out of work at this late hour are still allowed to use the kitchen. But another resident had also pushed in. When his colleague tried to push him out of the room, the 28-year-old Afghan tried to punch him in the face. "From the corner of my eye I saw how the other was beating towards my colleague," continued the security guard. The two guards should have fixed the rampage on the floor. The Afghan then tried to drag her down from the roommate. "Then I suddenly got a hit or two on the back of the head," the man recalled. The police were called and he himself was taken to the hospital.

The colleague's statement largely confirmed the information provided by the Austrian, as did the statement by a policeman (24) who was on duty during the night of the crime. After hearing the witness, a cell phone video of the beating was spotted by a resident of the property. Then there was only a hit with a loudspeaker.

It was only by chance that the injuries were not serious, the prosecutor said. Nevertheless, they are not small, the head is also a very sensitive area and the blow is ambushed. Twelve months of probation with a probation period of three years are appropriate here, as well as a fine of 600 euros in favor of a social institution. Finally, the 28-year-old left the court with a one-year suspended sentence and under the condition that he did 120 hours of social work.
