2020-06-08T20:55:56.070Z

The middle-aged man was stopped by MTR staff after tripping at the MTR station in Central in October last year. He was subsequently accused of slapping staff for 8 bars in a row. He denied an ordinary assault crime, and the case opened today (8th) at the Eastern Magistrates' Court. After the station officer stated that he was intercepted, the defendant replied: "Are you a mistress?" Then he used his left and right hands to slap both sides of his face, a total of 8 times. He described the slapping effort as "Old Dou Jiaozai", not too heavy. The defense questioned that he had been beaten while standing, without self-defense. The station director said "heavy enough to withstand it" and added: "Why not be beaten, we must listen to a passenger." Magistrate Xiang Shuxian ruled that the evidence was established.

The defendant, Tan Weilin (age 38), denied attacking the man Mo Zhifu in the lobby of Exit A of the MTR station in Central on October 14 last year.

The defendant slapped the staff member 8 times in the right face after tripping

Station Director Mo Zhifu confessed that he was there at 7 o'clock that night because of broken glass at the gate to remind passengers to be careful. During the period, the defendant tripped. He stopped and said, "Sir, what are you doing?" The defendant turned around , Mo Paika went out and asked again, the other party asked back: "Are you dying?" Then he slapped his left face twice with his right hand, then slapped his right face twice with his left hand, and then repeated the action, that is, a total of slaps 8 times.

The crackdown is like "Old Dou Jiaozai"

Mo felt a little pain, describing the slapping strength as "old sinus teacher", not a heavy hand. A pair of men and women separated the two and persuaded each other. After that, the police arrived to subdue the defendant.

When questioned by the defense attorney Li Jianhua, he said that he had never been fought back for about 20 seconds during the slap. The defense questioned that he had failed to protect himself. Mo explained: "I think Zhong can stand it." And he did not say that the other party would immediately fight back when he was trained, depending on the situation.

Fighting back will make things worse

Regarding whether the training taught him to be "beaten", Mo said: "Well, it's about being beaten, it's about listening to a passenger." He reiterated the strength of the other party. "It's not until a thump hit you", so he continued to stand and wait for the other party. Respond.

Mo said that he did not block the grid, hug his head or push away the defendant, because this is a counterattack and will make things worse. He also said that there was no way back. Mo Xudao said that the company did not provide guidance for employees to stand up and be beaten, but emphasized that he was performing his duties. This is related to his sense of responsibility.

Denied denying the accused

The defense stated that Mo had become impatient due to multiple trips during the incident, so he pointed and scolded. The defendant stopped and turned when he heard Mo stop loudly for the second time after the trip. Mo Yangyan: "I want to whip you! You go!" At the same time, holding the walkie-talkie in your right hand and waving forward. Mo only agreed to lift the intercom, but he disagreed with other claims.

The defense said that Mo's reaction was unreasonable and anti-intelligent

The defense continued to point out that Mo was approaching the defendant. Because the two were too close, the defendant extended his hands and pressed Mo's face, and Mo had hit the defendant's arm with his right hand several times. Because the defendant did not want to shrink his hand, Mo immediately shouted that the defendant beat someone. Do not deny the above matters. He also disagreed that the defendant would reach out and push the block because of his bad pressure, so that the two parties would have physical contact. The defense stated that its attack response was unreasonable and anti-intellectual, and Mo expressed disagreement.

Mo Zhi told the police that he was beaten on the spot, and was sent to the hospital on the same day to ask for an examination, but he did not explain how often he slapped. He agreed with the written testimony admitted two days after the incident, only to mention the first 8 slaps.
