What we know about Idaho's missing children when their mother and husband face charges

(CNN) - Both the mother of the two missing Idaho children and her husband are now facing charges related to their disappearance.

Chad Daybell appeared in court on Wednesday accused of destroying evidence. His arrest came after the discovery of human remains on his property. His bail was set at $ 1 million.

Daybell is married to Lori Vallow, whose children, Tylee Ryan, 17, and Joshua "JJ" Vallow, 7, have not been seen since September.

Vallow is awaiting trial on multiple charges, including two serious felony crimes of desertion and non-child support, according to a criminal complaint filed with an Idaho court.

What we know

The remains found on Daybell's property are from children, Fremont County Prosecutor Rob Wood said in court Wednesday, when Daybell's bond was set.

The charges against him allege that he hid the remains sometime between September 2019 and June 2020, in other words, between the time the children were last seen and now.

Tylee was last seen when she visited Yellowstone National Park on September 8 with her brother, mother and uncle, Alex Cox, according to authorities. JJ was last seen at school in Idaho later that month.

Vallow and Daybell were married in November, shortly after their previous spouses died and Vallow's children were last seen.

The authorities carried out a welfare check for JJ that same month at the request of his relatives, who had not heard from him in months. When they arrived, Vallow informed them that he was not at the family home because he was staying with a family friend.

Police returned the following day to carry out a search warrant after finding it was not true, but Vallow and Daybell were gone.

They were later found in Hawaii, and despite police requests, they did not cooperate or introduce the children.

What we don't know

Some key elements of the case are still unknown.

Although the children's families said in a statement Wednesday that the remains "are in fact our beloved JJ and Tylee," authorities have not yet confirmed the identities.

"This is the worst news we will ever receive and we want to be left alone for now," said Larry and Kay Woodcock, JJ's biological grandparents; Colby Ryan, son of Lori Vallow from a previous marriage; and Kelsee Ryan, Colby's wife, in their statement. "Once officially confirmed, the statements by the Rexburg police, the medical examiner and the FBI will be released."

If the remains are from the children, it remains unclear how they died. An autopsy on the remains is pending, Rexburg Assistant Police Chief Gary Hagen said in a statement.

An answer to those questions would also provide clarity on whether more charges will come.

Daybell's attorney, John Prior, argued that his bail should not be as high in relation to his indictment just because "there may be something more to come."

People close to the couple have expressed concern over their strong religious ideologies and the death of Daybell's previous wife, just weeks before her marriage to Vallow, being classified as a suspect.
