Police violence: amicable agreement between France and the family of a Franco-Senegalese

The French government will pay 145,000 euros to the relatives of Lamine Dieng, a 25-year-old Franco-Senegalese who died in 2007 after a muscular arrest in Paris, in order to settle the lawsuits against France, AFP learned Monday at the European Court of human rights (ECHR).

French justice had dismissed the young man's relatives and they had brought an application before the ECHR in December 2017. But the Strasbourg court did not have to consider the merits of the case: the parties have In the meantime, an amicable agreement was reached, approved on May 14, which settles any prosecution in this case.

" The Court received the declaration of friendly settlement by virtue of which the applicants agreed to renounce any other claim against France concerning the facts giving rise to this request, the Government having undertaken to their pay the sum reproduced in the attached table ”, or 145,000 euros, notes the ECHR.

The Court takes note of the agreement reached between the parties. It considers that this agreement is based on respect for the human rights guaranteed by the Convention and its protocols and sees no reason which would require it to continue examining the request concerned, ”continues the European body. Lamine Dieng's family is delighted with this settlement, which for them constitutes " a victory ".

" We have lived thirteen years of fight against the denial of justice, in front of an institution which systematically refused us a lawsuit for those responsible for the death of our son, brother, uncle, " said in a statement the family of the victim through the voice of his sister Ramata Dieng.
