Seine-Saint-Denis: Adama Cisse, the garbage collector dismissed for a nap photo, is unemployed

Last January, "Le Parisien" revealed the fate of this garbage collector, dismissed in 2018 by his employer, the company Polysotis, a subsidiary of the Derichebourg group, following the publication on Twitter of a photo of him asleep in the streets of Paris.

Sent back for "serious misconduct", the 37-year-old man had seized the industrial tribunal of Créteil (Val-de-Marne), which must render its decision this Friday.

The affair had caused a stir at the start of the year, giving the 37-year-old cleaning agent, of a rather reserved nature, a reputation that clearly exceeded him: “Even abroad, people m 've seen on TV. "

CDD in a cleaning company

In this media whirlwind, a hand was stretched: an elected PS of Bondy, Nabil Larbi, supported by the mayor Sylvine Thomassin, had helped Adama Cissé, then in great precariousness, to find a job. At the end of January, they put him in touch with a cleaning company. Adama Cissé had then signed a fixed-term contract which was then, it was promised, to be transformed into an open-ended contract. His new employer simply demanded to remain anonymous, to avoid media overexposure.

But things stopped dead, with the health crisis. “My contract ended on March 19, after I received my account balance. I was told that we had to wait for the coronavirus to end, ”says Adama Cissé.

Joined in early April, he seemed to be taking his patience patiently. After all, his job was to empty the baskets in a Parisian park, closed since the start of confinement. He therefore hoped to find a contract when it reopened.

"We will not let go"

The park has reopened, but Adama Cisse is still waiting. At the town hall of Bondy, Nabil Larbi, municipal councilor responsible for local urban management, ensures that he will soon find his job. “We contacted the company. It has not yet fully resumed its activity. But as soon as this is the case, Adama Cissé will resume his functions. We trust the employer, he will keep his commitments. ” The elected official indicates that he has established a “friendly relationship” with the person concerned: “We keep a close eye on his situation. We will not let go. ”

Since mid-March, Adama Cisse has again been unemployed. He claims 30,000 euros from his former employer

"It's difficult," he admits without going further. At the industrial tribunal, his lawyer Joachim Scavello claimed a sum approaching 30,000 € - including damages for dismissal without real or serious cause, severance pay and months of notice not received. "My hope is my lawyer," says Adama Cisse, when asked if he hopes to succeed.

He is still thinking of launching another procedure, against the surfer who had taken his photo without his knowledge, one day in September 2018 in a Parisian street. "Even today, it still hurts me," he slips.

Dressed in his work clothes, the cleaning staff had fallen asleep on the edge of a window, barefoot, his work shoes next to him. The photo, posted on Twitter, along with an acid comment on the cleanliness of the streets of the capital, had attracted the attention of the services of the City of Paris.

The latter then alerted their private service provider, the company Polysotis. Adama Cisse had been dismissed on October 11, for serious misconduct. "A case tried without the necessary hindsight," said Maître Scavello, for whom the photo "is not acceptable proof".

The Derichebourg group had, for its part, justified the dismissal procedure by accusing the employee of having exceeded his break time - which he disputes. And to have behaved in a manner that did not comply with "the internal regulations and the commitments of his employment contract".
