Covid-19: lawyers pressured to obtain the opening of judicial information

Two lawyers, Me Fabrice Di Vizio and Me Arié Alimi, announced in press releases on Tuesday the filing of complaints with the constitution of civil party in order to obtain the appointment of examining magistrates to investigate different aspects of the management of the crisis of the Covid-19.

The two lawyers had already filed simple complaints at the end of March before the Paris public prosecutor's office, which led, with others, to the opening on June 8 of a vast preliminary investigation for " involuntary homicides " or " endangerment of the lives of others ”, and entrusted to Oclaesp, the Central Office for combating damage to the environment and public health.

Collective of doctors

Me Di Vizio represents a group of doctors called C19 who in his complaint targeted the Director General of Health, Jérôme Salomon, accusing him of the lack of supply of masks to doctors and more generally of " voluntary abstention " from taking measures against the Covid-19. Me Alimi had complained to him on behalf of the Inter Urgences collective on the " management of the Covid crisis and the endangerments relating to it ". In press releases sent to AFP on Tuesday, the two lawyers are now announcing complaints with a civil party.

If the public prosecutor to whom the initial complaint is addressed announces to the complainants that he does not intend to prosecute, or if three months have passed since the filing of the initial complaint, the complainants have the right to lodge such complaints say CPC which allows them to obtain the opening of judicial information and the appointment of an investigating judge. The prosecution may, however, ask the investigating judge to extend his investigations for three months.

" We no longer hear about " the preliminary investigation of the Paris prosecutor's office, justified Me di Vizio in a press release. Me Alimi argues in his " need to shed all the light and in complete independence " on the management of the crisis. The opening of judicial information, as Me di Vizio recalls, "would also divest the parliamentary commissions of inquiry of their mission ".

The National Assembly's commission of inquiry began its work on June 16, and in particular heard on June 24 the controversial promoter of hydroxycholoroquine, Professor Didier Raoult. The Senate voted unanimously on Tuesday to create its own.
