The National Treasury Prosecutor, Carlos Zannini, was denounced by the national deputies of Juntos por el Cambio for the crime of prevarication for having restored Amado Boudou's privileged pension .

The opposition legislators considered that the disposition to revoke a resolution of the macrista administration that prevented the collection of the life pension by the former vice president, harmed the interests of the State. ANSES has enabled payment but cannot collect retroactive payments. The disbursement of the allocation would be around $ 420,000. The case was filed with the court in charge of María Servini.

The discussion that had taken place in the political arena, landed in the Comodoro Py Courts, where Carlos Zannini was denounced by the opposition deputies Waldo Wolf, Juan Manuel López, Álvaro De Lamadrid, Jorge Enriquez, Fernando Iglesias, Pablo Torello and Julio Shad .

In the text, to which Clarín agreed, they asked that the possible commission of crime by the Treasury Attorney be investigated. The complaint maintains that "Dr. Carlos Zannini intentionally harmed the interests entrusted to him, ruling contrary to the legal provisions incorporated in the International Treaties to fight corruption that our country promised to respect and express legal norms, to illegally favor Amado Boudou, with whom he has a long personal relationship. "

On June 18, the Treasury Prosecutor revoked the resolution by which the previous Government had decided not to grant Amado Boudou  the collection of his life pension as former vice president. The management of Mauricio Macri had maintained that the former official K should not collect that pension as he was convicted of bribery and incompatible negotiations for the acquisition of the former intaglio Ciccone.

During the previous administration, through an official resolution, ANSES had ruled that Boudou could not collect his life pension as former vice president. The pension agency had considered that due to the sentence that Boudou received to five years and ten months in prison with a life-long disqualification from holding public office in the Ciccone case, he was not in a position to receive that benefit that would ensure that he received monthly and for life about $ 420,000.

Amado Boudou had requested, through his attorney, "the revocation by illegality of RESOL-2018-1-ANSES- DOCP # ANSES; the recognition of the resulting credit in favor of the interested party since his resignation as Vice President, as a consequence of the invalidity of the act denying the benefit, and the offer of a deduction on the sums accrued ".

Consequently, Zannini considered that the claim was admissible and argued that the only instance in which the life pension should be deprived is in the event of impeachment. For this reason, he understood that the reasons given were valid by the former vice president. He pointed out that the resolution issued on November 16, 2018 by the ANSES Centralized Benefits Operational Directorate, "clearly departed from the express text of article 29 of Law No. 24,018 by denying the granting of the Monthly Allowance Life requested by the former Vice President of the Nation, attorney Amado Boudou ".

Following Zannini's decision, last week, through resolution 230/2020, signed by Fernanda Raverta, ANSES resolved to pay the monthly allowance that corresponds not only to Boudou but also to former President Mauricio Macri, to the former Vice President Gabriela Michetti and former judges of the Court. But she decided to suspend the payment of retroactivities "while the public emergency in health matters lasts" established by the Emergency law, extended until March 2021 by DNU 260/20.

In this scenario, the deputies of Together for Change, indicated in their complaint that there was "intentional damage to the interests of the National State, which the Treasury Attorney of the Nation is responsible for safeguarding as head of the body of State Attorneys, because it implies enabling the retroactive payment of an ex gratia pension for life ".

On the other hand, they indicated that this determination must be "supported by the honor and merit in the exercise of the position of, who to date has the character of a condemned person, to the penalty of five years and six months in prison, plus absolute disqualification perpetual, for the crimes of passive bribery and negotiations incompatible with the public function. The sentence was imposed by the Federal Oral Court No. 4 on August 7, 2018 and confirmed by the Federal Chamber of Criminal Cassation, "they recalled.
