"Minato City National Security Law" was released on the evening of June 30, and the details of the provisions were finally exposed. There are many places in the bill that demonstrate "iron fist" authority, including the National Security Committee established by the Hong Kong Government. The decisions made are not subject to judicial review.

National Security Council work letter does not disclose any institutions, individuals must not interfere

Looking through the provisions, there are many places that show the authority of official institutions. Article 14 of the provisions states that the work of the National Security Committee established by the Hong Kong Government shall not be interfered by any other agencies, organizations and individuals in the Hong Kong Special Administrative Region, and work information shall not be disclosed. Decisions made by the National Security Council are not subject to judicial review.

When investigating cases involving national security, the police have the right to search premises, vehicles, ships, aircraft, and other relevant places and electronic equipment that may contain criminal evidence. It does not specify that court authorization is required. The interception of communications and covert surveillance only need to be approved by the Chief Executive, which is different from the current need to obtain the authorization of the panel judge or designated authorized personnel.

After the approval of the Chief Executive, the expenditure and establishment of all national security-related departments of the Hong Kong Government shall be earmarked from the general revenue of the Government, and shall not be restricted by the relevant laws and regulations in force in the Hong Kong Special Administrative Region.

National Security Administration personnel performing their duties are not subject to the jurisdiction of the Hong Kong Government

According to the provisions, the National Security Office of the Central Government in Hong Kong also has considerable authority, and it also involves the appointment of the head of the Hong Kong department. The provisions refer to the National Security Department of the Police Department and the Department of Justice. Before appointing a person in charge, the Hong Kong Government must solicit written opinions from the National Security Agency established by the Central Government in Hong Kong.

Article 60 states that the National Security Agency and its personnel performing their duties in accordance with the National Security Law are not subject to the jurisdiction of the Hong Kong Special Administrative Region. Related personnel and vehicles are not subject to inspection, search and detention by Hong Kong law enforcement personnel while performing their duties. To enjoy other rights and immunities provided by the laws of the Hong Kong Special Administrative Region, the Hong Kong government department must provide the necessary facilities and cooperation when performing its duties.
