The Syndicat de la magistrature (SM) is asking, this Tuesday, July 7, to the new Keeper of the Seals, Éric Dupond-Moretti, to put an end to the feedback of information on current procedures to the Minister of Justice, highlighting his ex-lawyer status.

" Your special position - until yesterday you were involved in a number of the most sensitive cases reported to the Chancellery - makes all the more urgent a clear commitment on your part to put an end to these practices which take effect immediately in practice by means of a circular, before being entered in the code of criminal procedure ”, writes the president of the SM (classified on the left), Katia Dubreuil, in a letter to the minister.

A strong “sign” from the new Minister of Justice

She added that such an initiative would be a " strong sign " of the Minister's desire to " advance the independence of the judiciary ". Ms. Dubreuil also calls on Mr. Dupond-Moretti to withdraw the mission entrusted in early July by her predecessor to the General Inspectorate of Justice (IGJ) in order to avoid " an obvious situation of conflict of interest ".

This inspection concerns a controversial investigation by the National Financial Prosecutor's Office (PNF), which lasted more than six years and during which the detailed telephone invoices (" fadettes ") of ten tenors of the bar, including Éric Dupond-Moretti, and magistrates were peeled. The said investigation aimed to identify a possible " mole " who could have informed Nicolas Sarkozy and his lawyer Thierry Herzog that they were wiretapped in another case, which brought them a trial at the end of the year.

Éric Dupond-Moretti had filed a complaint against X for " violation of the intimacy of private life and the secrecy of correspondence " and " abuse of authority " in this case, complaint withdrawn before taking office in the Chancellery, said the entourage of President Emmanuel Macron at AFP. The SM had already criticized this IGJ mission last week, considering that it " constitutes a dangerous departure from the road with regard to the principle of separation of powers ".
