From driving without permission through a burial to trying to circumvent a checkpoint: stories of drivers whose license was withheld

Since Tuesday, the Buenos Aires Government has kept 26 records for people who did not have a single, valid certificate enabling movement. This Friday some went to the Directorate of Infractions to retrieve them.

"I had to pay five thousand pesos," says Jorge Limoni. On Tuesday, when his mother-in-law died, he shot out of Zárate to the Capital.The 90-year-old woman lived in Once, and there were the documents that the family needed to be able to make the burial in the family cemetery. It was the first day of that penalty in the context of the coronavirus quarantine.

Limoni is an electrician and plumber, so he had the authorization to drive in his car on the other side of General Paz. "I did not even think about the issue of empowerment for the City, it was an emergency and my lady felt bad and I was not going to let her come by bus," he says from the line to enter the General Directorate of Administration of Infractions of the City. (DGAI).

The headquarters of the agency, located at Hipólito Yrigoyen 2346, reopened after almost 130 days of working only virtually. This Friday, the first drivers fined with the withdrawal of the license arrived, the only public that the DGAI will attend at the moment.

Limoni, 62, decided to pay the fine to avoid complications. “I explained what had happened to me, but they told me that it was still a fault and I did not want to appeal. In addition, they explained to me that if I paid at the time it was considered 'voluntary payment' and the fine was cut in half, ”he explained to Clarín .

The retention of driving licenses for driving without the corresponding authorization in the City of Buenos Aires came into effect this Tuesday, after the head of the Buenos Aires Government, Horacio Rodríguez Larreta, introduced by Decree of Necessity and Urgency (DNU) No. 9 / 20 the possibility in the Traffic and Transport Code.

From Tuesday, when the DNU came into force, until this Friday at 2 pm, 26 driver's licenses were retained, sources from the Buenos Aires Ministry of Justice and Security informed this newspaper.

When someone is detected circulating without the corresponding permit, a contravencional act is drawn up within the framework of Law 451 of the Faults Regime. In addition, an infraction record is made, your license is withheld and you are issued a Summons Ballot Z (form Z) for 10 business days. This allows you to continue driving until the violation is resolved.

In addition, the possibility of kidnapping the car is foreseen in the event that the person is found violating the prohibitions on driving. Clarín was informed by the Ministry of Justice and Security of Buenos Aires that until Thursday no vehicles had been hijacked.

In order to recover his license, the offender must approach the DGAI only 72 hours after the fact to resolve the violation. You can pay it or appeal it.

The  fine  for driving in a car without the corresponding permit has a cost of between 10,700 and 79,180 pesos . They are between 500 to 3,700 Fixed Units, which today have a value of $ 21.40 each. In case of making a voluntary payment on site, there is a 50% discount.

Previous violations must also be considered. In the event that the driver had them, in order to recover his retained license he  will have to "get right" with all of them, the Buenos Aires authorities reported. In other words, they will have to be paid. For this, they clarified in the Buenos Aires Government, there will be financing plans.

Julián Oh is sprayed with alcohol and his temperature is taken with a laser thermometer before entering the DGAI. In a confused Castilian, he tells Clarín that he is 48 years old and has lived in Argentina for almost twenty years. On Tuesday, the driving license was retained at a control of Juan B. Justo and López de Vega. "It is that the page does not allow me to enable, because it does not recognize my ID number, " says the man, a Korean national.

“I have to leave yes or yes, because I am in charge of taking care of my uncle and because I take merchandise to the clients. I have to work, I already have a lot of debt ”, he explains and clarifies that he tried“ more than a thousand times ”to get the rating. He says he will not appeal : "I do not want problems with the country, I am a foreigner and everything must be done well."

A neighbor in a wool hat approaches the entrance. "The patent came to pay a fine," explains one of the employees, Maria Teresa, who handles queries at the entrance. Like her, there are a few who see the DGAI open and come to ask for other reasons , despite the small signs printed on ream paper: “Attention to the public: only retention of driver's licenses, withheld from July 21 in ahead".

Carlos keeps the fine in his pocket again. "They kept my license in San Martín, but they told me to come here to claim it and here they tell me to consult with San Martín, that Province cases are not received here," he says.

Ezequiel Núñez, a motorcycle messenger, was also issued a license in control of Juan B. Justo and López de Vega. "The boys are going to help me pay, because I have 800 pesos maximum left and here they ask me for a 4,280 peso fine," he tells Clarín after leaving the public building.

"On Tuesday I saw the police there and tried to avoid her, but they followed me," continues Ezequiel. When I showed them the authorization, they told me that I was not going and that they were retaining my license the same, "he says and answers the phone: " What are you doing, 'show'? There it happened, yes, 5 thousand pesitos ” . She immediately walks away to look for an Easy Payment.

Once the offender enters the building, he is attended by a controller in a box where they set up plastic separations to prevent the transmission of the coronavirus. Of the 700 employees who work in the DGAI buildings, only 30 went back to work in person, according to sources from the agency.

The controller evaluates each case and sets the amount of the fine. In case you decide to pay it, the offender can do it in the same building with a debit or credit card. Also, you can pay online or in cash in an Easy Payment. The license is returned when the infringer shows proof of payment.

If the driver decides to appeal, instead, the DGAI employee returns the driver's license, but submits the case to the City Justice, which must determine whether or not it existed.

The DGAI attends without a prior shift from Monday to Friday from 9 a.m. to 3 p.m. only and exclusively for these procedures related to the retention of licenses in the framework of the quarantine by Covid-19. Since March 20, when compulsory isolation was decreed, 2,385 people were detained and another 36,367, delayed, notified or transferred to the home for violating the quarantine, sources from the Buenos Aires government indicated. The City Police kidnapped 457 vehicles.
