They denounce that they manipulated the cell phone of Fabián Gutiérrez after his murder and suspect that they deleted data

The phone of Cristina Kirchner's former secretary was sent to Buenos Aires for expert opinions and arrived in a torn envelope. In addition, it would have been on for 24 hours after its discovery. "The chain of custody was violated," said one of the defense attorneys.

Within a month of the murder of Fabián Gutiérrez, ex-secretary of Cristina Kirchner, the case was shaken by a fact that could complicate the investigation: the victim's cell phone was sent to Buenos Aires for an expert report but the envelope was open and they believe the phone was tampered with after the crime. There are even suspicions that data was erased.

"The envelope arrived open to the Gendarmerie in Buenos Aires, they violated the chain of custody, " the lawyer for one of the three detainees confirmed to Clarín

He described this fact as "very serious" and added: "Surely they deleted everything."

"The envelope in which the cell phone was sent by Correo Argentino in a box, without security. It's a crazy thing, I never saw that. It was opened with a knife or something similar," said the same source.

This irregularity would be reflected in a Gendarmerie report that was carried out on Wednesday and signed by lawyer Sabrina Mansilla, a partner of Carlos Telleldín, who defends Facundo Zaeta (the main accused).

The same lawyer who spoke to Clarín assured that in El Calafate, where the murder occurred, he was approached with versions that Gutiérrez's cell phone "contained delicate information related to clandestine gambling" in that city of Santa Cruz.

The black Iphone with red housing Gutierrez was found by investigators in an abandoned house in El Calafate hours before the appearance of the body. He was immediately kidnapped in court.

However, in the 24 hours after the discovery, the device would have been kept on and information from the "cloud" (iCloud) could also have been deleted , according to Opi Santa Cruz, based on documents from the case to which it had access.

Sources consulted by the same media explained that when a mobile phone is hijacked, by protocol the chip must be removed and under the act proceed to seal the test in order that it remains unalterable for subsequent expertise. 

Other lawyers Facundo zaeta, Carlos Muriete, also referred to the fact that the cell came in an envelope open to Buenos Aires: "If someone agreed to the phone, it means that the test in custody was raped and that results any kind of speculation that we must now investigate to find out where the person responsible is. ”

In this situation, the defense could request that the expertise sent by Gendarmería from Buenos Aires be annulled . A complaint against Judge Carlos Narvarte is also not ruled out for the alleged irregularities in the custody of the team within his court.

Careos and crime reconstruction

Narvarte ordered a series of judicial measures on Thursday to advance the case. 

One of them was  a confrontation that was carried out among the accused. From there the request to raid the house of one of them , in search of clothes and other items that would have belonged to Gutiérrez, came off.

Fabián Gutiérrez was found murdered on July 4.

Late in the afternoon the reconstruction of the murder began. This procedural action is only carried out in the presence of the judge, the detainees with their lawyers and the prosecutor Natalia Mercado, Cristina Kirchner's niece.

There are three detainees for the crime: Facundo Zaeta, Facundo Gómez and Pedro Monzón. They are accused of manslaughter doubly aggravated by treachery, cruelty and criminis causae , which carries a life sentence. For the judge, the crime had an economic motive.
