Mario Pergolini made headlines in the last few hours for his strong criticism of the Telework Law, passed in Congress. He called legislators "jerks" and said they "peed" on people, so it quickly became a trend on social media.
This Thursday, Jorge Lanata interviewed the Vice President of Boca on Radio Miter and both shared their views on the new norm and the labor reform, among other aspects derived from the coronavirus pandemic.
"What a quilombo you put together now!" Lanata began about Pergolini's strong statements.
"I complained about how they had legislated the telework law. I said the words that nobody wanted to hear, 'labor reform', and you always think that you want to subdue the worker or take advantages. And the truth is that it seems to me a little old, a little stupid. This does not mean that there are no bad entrepreneurs, obviously there are. Look how it is that now young people call themselves entrepreneur because the word entrepreneur seems an insult to them, "replied the former CQC driver.
Lanata added that the law voted in Congress was "political" and was armed "with the unions."
"I understand that you can tell me that it is something political, I am 56, I understand it again, but why do we have to eat all the goals ourselves? Why don't we start to be a little smarter? Understand what we have to do. a reform of this type but for good, "added the leader of Boca.
Still angry, Pergolini raised the tone of the conversation: " They are legislating labor on technological things with the thought of the 60s or 70s ."
In turn, Lanata pointed against "reversibility" and argued: "It is a delusion. The law gives you a period and if not, the guy is considered dismissed. It is an absolute delusion."
The businessman added: "We can legislate with well-armed rights. If I hire someone by telework for 4 months and extend it to 8 months, I know that he goes to any labor judge, he says it was a dependency relationship and he wins the trial. Every Once I hire someone, I think more about how I'm going to get divorced than how I'm going to be happy married. It's ridiculous. "
Pergolini also regretted that the text of the standard was not consulted with the private sector. "They say that the private sector tried, but they were told that they did not have time. How do you do without technicians to be informed? It is one thing to have informants and another to have information. They say that the Executive Branch will later modify it ... Well Why do they do that? Many laws are made just because, but we could start to avoid it. "
Last Thursday, the Senate approved a new regulation on the labor market. This is a new regime for teleworking, which will take effect 90 days after the end of the pandemic, and which has already received questions from the business sector.
The new norm establishes that workers who carry out tasks from their homes will have the same rights and obligations as those who carry out these tasks in person.
Some points that stand out are the “digital disconnection” and the possibility that the employee can go from working in person to teleworking in a few steps. Also that the employer must pay for the hardware and software that the employees will use. Workers will find help to cover the expenses they incur by working from home.
