(CNN Spanish) - The five phases of economic reactivation designed by the government are unconstitutional, according to the ruling issued this Friday by the Constitutional Chamber of the Supreme Court of Justice.
By executive decree the government had established five stages for the gradual operation of the different sectors, to try to avoid an abrupt increase in COVID-19 cases.
“In every country in the world, governments are ordering reopening gradually to control the pandemic. In El Salvador today that is also unconstitutional. They don't care about anything anymore? ”President Nayib Bukele wrote on Twitter.
According to the ruling of the Constitutional Chamber, the suspension and limitation of rights requires the approval of a law that regulates it by the Legislative Assembly. However, the Executive and the deputies have not reached agreements on the legal tools to deal with the coronavirus.
The magistrates clarify in the ruling that the Health Code empowers the government to issue the health protocols that people and companies must comply with in "workplaces, businesses, educational and recreational centers, homes and means of transport", as long as " they do not suppose a limitation or suspension in fact of the fundamental rights of the person ”, the sentence reads.
Phase II of economic reactivation, postponed twice due to the increase in covid-19 cases, was scheduled for August 20, which established the operation, among other sectors, of public transport, which was to supply alcohol in gel to passengers and carry only two people per seat. Users, for their part, had to wear a mask in order to reduce the risk of infection.
Until this Thursday, El Salvador reported 520 people died from causes associated with the new coronavirus and 19,544 positive cases.
