The boss of a country inn in Rhineland-Palatinate ended the annoyance about smoking breaks in his business with additional vacation days.
An inn manager gives non-smokers five
vacation days
per year
in his business
.
The
smoking breaks
in the company could be extrapolated to 8 to 15 days off per year.
Smokers are still allowed to take
cigarette
breaks.
Neustadt - Smoking breaks are part of everyday life in most companies.
Colleagues leave the office every hour to smoke a cigarette.
This break is denied to non-smokers.
A disadvantage that the boss of the Landgasthof Jägerstübchen no longer wants to tolerate.
Non-smokers get five days of free vacation in an inn in Neustadt
In the inn in
Neustadt-
Hambach (Rhineland-Palatinate),
non-smokers are to
receive compensation in the
future
.
Previously, the regular
smoking breaks had
led to
arguments
among colleagues.
For this reason, the owner of the inn decided
to give
non-smokers
five
days of vacation
per year.
“We are tolerant in our company.
The
smokers
don't have to stick out, ”said the inn manager Helmut Glas to RTL.
After the
disputes
among
non-smokers
and
smokers
increased, inn manager Helmut Glas calculated how much time his employees spend smoking per working day.
The result: An employee who
smokes
spends 8 to 15 working days a year during the
smoking break
and not at work.
So Glas came up with the idea of
giving
non-smokers
additional
vacation
.
Who smokes how much?
Age | Men (%) | Women (%) |
21-24 years | 36.2 | 23.4 |
25-29 years | 31.9 | 34.1 |
30-39 years | 35.0 | 27.4 |
40-49 years | 32.1 | 28.2 |
50-59 years | 30.0 | 24.8 |

Disputes about
smoking breaks
at work are a
thing of the
past.
Some
smokers
in the company are said to have decided to become
non-smokers
.
The head of the country inn is
also
largely satisfied
with his decision
to give
non-smokers
five additional days of
vacation a
year
.
“This is a solution that is good for our company, I don't know whether it will work for other companies,” says Helmut Glas.

Can the employer ban smoking in the workplace?
In principle, the employer has the right
to ban
smoking in
the workplace.
The
employer
can
make use
of his right of
direction
for
this purpose
: According to §106 trade regulations, it is possible for him
to instruct
the
employees
at his discretion.
He decides how the
employees
behave in his company, provided that this does not contradict other contractual agreements.
Important: The
employer
must first consult the works council and
negotiate
a works agreement on the
smoking ban
.
In order to
enforce
a
smoking ban
, the employer can refer to the protection of
non-smokers
.
According to the workplace ordinance, the
employer
must
guarantee
the safety and health protection of his
employees
.
This means that
non-smokers
should not be exposed to the dangers of passive smoking.
Does the smoking break count towards working hours?
Smokers
are not entitled to a paid
smoking break
.
So the cigarette is not part of working hours for in between.
In companies with so-called “trust-based working hours”, the smoking break is difficult to deduct from working hours.
After all, there are no official records of working hours and employees can organize their working hours freely.
