She was sentenced to three months suspended prison sentence.

A co-defendant unemployed lathe operator (59) was convicted of aiding and abetting 90 daily rates of 15 euros each.

“It is correct that I fled with my daughter on November 7, 2018,” confirmed the defendant, who lives in a community in the northern district.

“That was an absolute act of desperation.” On that day, the girl was supposed to be picked up by her supplementary carer and taken to a facility in Berchtesgaden - against his will, as the mother emphasized.

The social worker appointed by the court was responsible for “determination of residence, health and school matters”.

The parents have thus lost the right to determine the place of residence.

"With the escape I wanted to make my daughter well."

Accused mother in court

"I wanted to escape my daughter's well," said the defendant.

"The authorities made decisions that were not in the best interests of the child," added the girl's father.

“Your will to want to stay with your parents was not respected.

I clearly supported the plan to escape. ”So he called the social worker that day and said the girl had run away.

In fact, the three were already sitting in the car to Saxony.

Arrest at a motorway service area

The mother and daughter lived there with the co-defendant for two months.

In a village near the Czech border.

Everyone there knew her story, with which she had turned to the European Court of Human Rights in the meantime.

The police were already looking for their mother and daughter, tapping their phones.

The Kripo found out that the mother was planning to cross the border to the Czech Republic, where she booked a pension for a week on January 6, 2019.

One day later at around three o'clock in the night, the accused and the girl were arrested at a motorway rest area near Chemnitz.

"The Czech Republic was a crazy idea, so she immediately rejected the plan," said the woman.

That night she was on her way back to Bavaria because she recognized the hopelessness of her action.

According to the defense attorney, the route taken by the defendants spoke for this.

It led far from the Czech border.

The question of why the police, who had known the whereabouts of the mother and daughter since mid-November 2018, had not accessed earlier despite the court-ordered release order, remained unanswered.

Girl want to go back to mom and dad

“It's a drama,” summarized Judge Helmut Berger at the end of the evidence.

The girl, who is now 15 years old, suffers most from it.

"She is not feeling well.

She can't get involved in the clinic and wants to go back to mom and dad, ”reported the supplementary nurse.

"My impression is: She is serving her time there." The court saw the charge as proven.

Defense attorney Georg Schulte had demanded an acquittal.

The verdict is not yet legally binding.
