The Affected TDI platform is preparing the largest lawsuit against the Volkswagen group in Spain for the case of manipulation of the emissions of some vehicles when they were subjected to laboratory tests, better known as

dieselgate

.

According to the platform itself, more than 5,000 customers will join in a lawsuit against the Volkswagen, Audi, Seat and Skoda brands.

Even so, the lawyer Manuel H. Vilches, managing partner of Vilches Abogados and responsible for the legal advice of Affected TDI, assures that "this is only the tip of the iceberg, because throughout Spain there are 683,626 affected who are entitled to compensation for damages up to 6,000 euros each and they don't even know it.

The German consortium admitted in September 2015 to tampering with more than 11 million diesel cars worldwide with a device that altered actual nitrogen oxide (NOx) emissions while undergoing laboratory testing.

The company reached an agreement in the United States by which it compensated those affected with a total of 17,500 million dollars (14,817 million euros), while the Department of Justice imposed a fine of 4,300 million additional dollars (3,900 million euros). euros).

For its part, in Germany, Volkswagen and the Federation of German Consumer Organizations (VZBV) reached an agreement whereby the consortium will pay 830 million euros in the country to put an end to the judicial process.

The corporation thus put an end to the macro demand that brought together some 460,000 clients.

“The most striking thing is that the Volkswagen group has indeed compensated its American and German users.

However, so far it has refused to do the same with the Spanish.

Is it that your clients in Spain are in a worse condition or second-rate clients? ”Says Vilches.

The lawyer emphasizes that "the action to claim prescribes soon, at the end of the year, and ensures that" those affected can have absolute peace of mind that this claim will not cost them a single euro if they do not win, and that they do not assume no risk, since, if someone loses, they would not even have to pay court costs ”.

On March 11, the plenary

session

of the Supreme Court established the obligation to compensate

someone

affected by

dieselgate

.

The Supreme Court appreciated the existence of damages for which those affected must be compensated and enabled the power to claim directly from the Volkswagen group without the need to sue the dealers, as had to be done before

The basis of the class action lawsuit that will now be filed in Spain is that the almost 700,000 people who bought a TDI from the German group between 2009 and 2015 did so "being victims of a hoax," according to the platform.

"This deception is what gives them the right now to claim compensation for damages," they claim from Affected TDI.
