Judges case: in the Court the previous agreements were broken and the negotiation returns to zero

Fought over what the press publishes and without meeting, the ministers will draw up their individual vote and then try to agree on a sentence. Maqueda, in the crosshairs.

The government's hypersensitivity to the news published by the press spread to the top of the Judiciary, where those opinions should be less influential than in any other sphere.

After having been at the gates of an agreement to sentence the fate of judges Leopoldo Bruglia, Pablo Bertuzzi and Germán Castelli - displaced by Kirchnerism - the ministers of the Supreme Court

broke the bridges and amid mutual reproaches withdrew from the palace without even meeting.

Now each one will write their vote alone, and only then will they try to sew those scraps together to get a sentence.

This Thursday everything was confusion around the highest court.

Even some ministers were unaware of what was happening to the others.

That entropy had begun when on Sunday

a possible plan to satisfy the government with a controversial move

transcended through

Clarín

: return the corridos judges to the desks from which they had been thrown -Bruglia and Bertuzzi in the Buenos Aires Federal Chamber and Castelli in the TOF 7- but

in a transitory way

, until the Judicial Council organizes the contests and conforms the shortlists so that the president chooses the final candidates from among them and then the Senate approves them.

That martingale clashed head-on with what the same Court had written in the Agreed March 7, 2018

, signed by judges Ricardo Lorenzetti, Horacio Rosatti and Juan Carlos Maqueda.

That majority - which a year later added the adjective "Peronist", when it sought to enhance the loneliness of the new president of the body, Carlos Rosenkrantz - now have on their shoulders the gaze of a sector of society that is especially attentive to the pulse with which the institutions function. .

It is then that the three ministers approved the transfers of judges "to perform functions of the same hierarchy within the federal jurisdiction, with equal or similar material competence",

without requiring a new Senate agreement or presidential appointment

, such as it was expressly indicated in section VIII of the Agreed Agreement.

If now it were decided to make these transfers transitory until a new contest is held, Lorenzetti, Rosatti and Maqueda would have to explain very well

that diametric change of opinion in just two years.

And to top it all, regarding the same judge, Leopoldo Bruglia, whose transfer caused the Acordada 7.

The other two ministers of the Court, Rosenkrantz and Elena Highton, had already endorsed the transfers in the previous Agreement 4, with a much broader criterion and without conditions.

Rosenkrantz maintains that gaze, which he already wrote in his vote

regarding Bruglia, Bertuzzi and Castelli.

He just has no one to share it with.

Highton would also find it difficult to justify leaving that position in such a short time, but

even his colleagues do not know what his criteria will be in this case

.

Insights about her close relationship with Alberto Fernández and Justice Minister Marcela Losardo fly over the lady.

The game is then reduced to the cards of Lorenzetti, Rosatti and Maqueda.

From the courts they assure that, infrequently,

Maqueda from Córdoba was the promoter of a resolution

regarding the judges that, ultimately, makes the government smile.

Rosatti would have been willing to accompany him in general terms, but in recent days he has shown deeper differences.

Lorenzetti, on the other hand, does not want to hear about majorities, despite the fact that for years he boasted - with good reason - of being a builder of them to give "stability and predictability" to a Court responsible for the formulation of "State policies" .

After Tuesday's failed attempt to close an agreement that seemed imminent, the connection between them was left with bare wires, as it was exposed this Thursday.

The differences are no longer legal and not even political, but personal

: mistrust prevails among several of the ministers;

Leaks, betrayals and operations in the media are reproached, which the alleged victims in turn replicate in a mirror.

Links with the government are another source of itch.

To the well-known tension between Lorenzetti and Rosenkrantz since the porteño replaced Rafaela's lawyer as president, we must add Maqueda's personal coldness with Rosenkrantz, and now

Lorenzetti's growing discomfort with Rosatti

.

It is difficult to work like this.

This Thursday at 2 p.m. the fourth floor of the courts was almost empty. The ministers will spend

"a weekend of introspection and analysis,"

according to their close collaborators. A return to zero pages. As this newspaper warned two days ago, citing a secretary of the highest court when everything seemed defined: "until the chicken comes out of the oven, it is a hen cackling in the corral." I was right.
