This August 21, 2016, in the staircase leading from the first floor of a wing of Luynes prison to the promenade courtyard, one of the few places in the prison not covered by CCTV cameras, Alain Boudara, 26 years old , had received a blade of scissors right through the heart.

Mohamed Belhacène, who admitted to being the author of the fatal blow, denied having intended to kill, but on Tuesday the jurors of the Assize Court of Bouches-du-Rhône retained the qualification of intentional homicide.

In the fight, he held me by the collar, I pushed him away.

He then took out the blade but I took it and punched it.

I did not know where I hit,

”explained the accused.

Conversely, according to Advocate General Christophe Raffin who had required 30 years of imprisonment, Mohamed Belhacène "

planted a blade with force in a vital region which pierced the heart and this signals a homicidal intention

".

The weapon, a scissor blade, had been found in the drain of a shower in the promenade courtyard, carrying a mixture of the DNA of the victim and Mohamed Belhacène.

This fatal cut of the scissors followed a banal incident between the two young prisoners, which had occurred a few hours earlier, during the service of the mess tin.

Words, insults exchanged, "

as we see every day in prison between small clans who bicker

", according to a supervisor.

Despite the presence of 23 other detainees on the stairs, the police had not obtained any testimony, deploring "

the law of silence

" in prison.

A few months later, the delegates of the Comptroller General of places of deprivation of liberty dispatched to the site had recorded 112 attacks between detainees in ten months, 455 against guards and two serious attacks with a knife.

The controllers "

met detainees who are afraid, no longer go out for walks, remaining cloistered in their cells, without any activity

".

Mohamed Belhacène has already been sentenced for two murders to two 20-year prison terms - decisions not yet final - two settling of scores committed in 2014 in connection with drug trafficking.

The victim, who was serving seven years in prison for eight different convictions, had just been transferred to Luynes after having stabbed a fellow inmate in another prison.
