The announcement of a commission to rewrite article 24 of the “Global Security” bill had provoked an outcry.


The controversy over the creation of an external commission to rewrite the very contested article 24 of the proposed law “Global security” turns to the exchange of letters between high-ranking officers of the majority.

Jean Castex's response to Richard Ferrand's letter was not long in coming this Friday afternoon.

"I fully understand the emotion among the deputies whom you have relayed," said the Prime Minister, who also took the pen, to the President of the National Assembly.

By this letter, the head of government intends to "specify the intentions of the government", while hammering his "respect" for "the Parliament and the work of parliamentarians who are the only competent, at the end of article 24 of the Constitution, to pass the law ”.

Faced with the indignation provoked in Parliament, Jean Castex thus certifies that "it will not fall within the scope of this commission to propose a rewriting of a legislative provision, a mission which can only be the responsibility of Parliament".

A back-pedaling, therefore, on the announcements of the day before, which did indeed evoke "a new writing of article 24".

What mission?

"It appeared necessary for the government, to nourish its reflection, in view of the debate which has taken place in society to be able to benefit from the insight of an independent commission (...) in order to develop proposals on the best way to reconcile absolute respect for the fundamental right to information and the protection of the security forces, which are essential in a democratic society, ”explains the Prime Minister.

What mission for this commission?

Its proposals, writes Castex without further clarification, are not intended to be only legal and should also more broadly relate to procedural or training issues, as well as to the working conditions and intervention of the press and law enforcement.
