Court ruling: No extra money for dog liability
The new ruling of the
Federal Social Court
is about so-called Hartz-IV-Aufstocker.
These are
employees
who can also receive Hartz IV if their own money is not enough for the cost of living.
Now, according to the decision of the
Kassel
Federal Social Court, Hartz IV recipients * should not receive any additional money for the liability insurance of their dogs.
That causes a stir.
Because this insurance is
compulsory
in some
federal states
such as Hamburg, Berlin, Lower Saxony, Saxony-Anhalt or Thuringia

The judgment comes as a
surprise
to many
Hartz IV recipients
because the insurance premiums
can often be
deducted
from the creditable
income

The income in turn determines the amount of the top-up
Hartz IV amount.
Dog liability: Hartz-IV-Aufstockerin had sued in court
However, this is not the case with
dog liability insurance
- regardless of whether it is mandatory or not.
The Federal Social Court came to the decision after a
Hartz IV supplementer
sued because she could not withdraw the insurance for her bitches.
Their lawsuit was dismissed by the court.
The reason given was that a
hobby
such as
keeping dogs was
not included in the normal cost of living.
No additional expenses for
pets
are therefore
provided
for in the Social Security Code
.
If a
Hartz IV recipient
wants to keep
a
dog
, he or she must take the necessary money from his Hartz IV rate.
The statutory insurance must be deducted from income in accordance with Section 11 Paragraph 1 No. 3 SGB II.
The dog tax is levied
by the respective
municipality
