Basement too high: construction freeze for three-in-handers in Holzkirchen

- A quiet building site, a three-horse car with a south-facing view: At the confluence of Schönlohstrasse and Valleyer Weg in Holzkirchen, the workers started in spring 2020, dug the construction pit and concreted the cellar walls.

But on May 27th it was over: As the district office confirmed on request, the construction site was closed by the building supervisory authority.

Because it was obviously foreseeable that the building would be significantly higher than planned in the development plan.

Holzkirchen's mayor Christoph Schmid (CSU) explains on request that “the building applicant did not adhere to the regulations of the development plan”.

The cellar structure comes out too high.

According to the district office, the market town had asked the building supervisor of the district office for a review when the unauthorized height became apparent during the basement work.

Apparently neighbors had pointed this out.

In the town hall one does not want to say anything further, with reference to data protection.

It is unclear how the closed construction site will continue.

There is no information on whether and how they contacted the developer.

It would be conceivable that the municipality changes the development plan or grants an exemption in order to legalize the previously illegal amount.

“We haven't received any such requests yet,” the mayor says when asked.

The district office announced that they will wait and see how the community reacts.

If the town hall adheres to the requirements of the development plan, the district office will initiate “further steps”, as the authority announced.

That could mean that a deconstruction is ordered.

The three-in-hand car fills one of the last gaps in the development plan 42 (“between Austraße and Valleyer Weg”), which was launched in October 1993.

Large parts of the large meadow between Angerstrasse and Valleyer Weg do not belong to this development plan.
