For decades there has been an ongoing feud between Anzing and Markt Schwaben over a drinking water protection area.

The Environment Committee has now spoken in the state parliament.

The petition from Anzing regarding the “water dispute” was discussed and decided on - surprisingly at short notice for some - on Thursday in a specialist committee of the state parliament.

The result in advance: Now everyone involved, especially the communities of Anzing and Markt Schwaben, but also the district office and the water management office, must quickly find ways to find a solution that is acceptable to everyone.

At the meeting of the Committee for Environment and Consumer Protection in the Maximilianeum, a complaint in the form of a petition submitted by Anzing's mayor Kathrin Alte in June 2023 was on the agenda.

After extensive discussion, the Anzing municipality announced that the committee unanimously made a decision to take the matter into account.

It is the state parliament's strongest means of calling on the state government to act on behalf of the petitioners.

According to a press release that the Anzing town hall published on Thursday evening, this means: The committee considers the request “to be fully justified and feasible.” It is now expected, it goes on, that the state government will implement the petition as soon as possible.

It was also decided that the authorities involved must find a common solution within four months and report on it to the committee.

The solution should be on the table in four months

“Since 1999 there has been no serious attempt by the higher authorities to designate this water protection area, which threatens the existence of our farmers,” said Anzing’s mayor Kathrin Alte.

In their eyes, it is “a great success” that the committee has now followed the Anzing municipality’s arguments and that farmers now have real prospects again.

“After the committee's decision, we have come a lot closer to our goal of not putting Well II into operation.

Now all of us - Markt Schwaben, Anzing, but above all the district office and the water management office - are called upon to find a real alternative for Brunnen II and not to put the issue on the back burner for another few years or decades," said Alte.

On behalf of the farmers, they and the petitioners' representative, lawyer Benno Ziegler, thanked the committee for the decision and support.

The issue has been bothering the affected farmers, the community of Anzing and the Markt Schwaben market for over three decades.

The background is the water supply in Markt Schwaben and the commissioning of Well II, which has been possible since 1999 and was intended to serve as the “second pillar” of the Swabian water supply.

In Anzing, if this were to happen, eight farms in Boden, Lindach, Staudach and Au-hofen would be affected by the possible designation of a water protection area.

As has been widely reported, the Anzing farmers have been resisting this for many years.

In order to bring this pending procedure to a solution, Alte, in his own words, submitted the petition in question.

It is said that the environmental committee has now determined that the district office's water protection area ordinance from 1988 is invalid.

Now a solution can finally be found in the interests of those affected.

THREE QUESTIONS FOR MARKT SWABIA'S MAYOR MICHAEL STOLZE

What does the outcome of Thursday's meeting in the state parliament mean in terms of local politics for the next few weeks and months?

There should and will be a working discussion with everyone involved (including the district office, water management office, experts, etc.) within four months.

This will certainly be preceded by bilateral discussions between the market town and the municipality of Anzing.

The municipality of Markt Schwaben was and is open to discussion in this regard.

What specific action does the market community need to take?

It should be mentioned that Well II is a so-called second mainstay for the drinking water supply, which is imposed as part of the water law abstraction permit for Well III.

If, for example, the active well III in the Ebersberg Forest or the connecting pipe between this well and the market town were damaged, then the second pillar - in the form of well II - would take over the supply.

The market town has already commissioned extensive tests and reports to identify supply alternatives for the market's water supply.

These results are already known and will certainly be included again in the following working discussions.

If, as the discussions progress, new situations arise that would lead to further care alternatives, the market is of course fundamentally open to this.

It goes without saying that economic aspects have a corresponding importance here.

What impact does the whole thing have on the market for Swabian water customers?

In connection with this issue, nothing will initially change for our customers - neither in terms of water quality, security of supply nor price.

The above-mentioned economic efficiency is of course important because as a water supplier we are a cost-calculating institution, which means that the fees (water price) must be calculated in such a way that the costs of the institution are covered.

Against this background, it is understandable that the Swabian market is approaching the upcoming discussions with the imperative of cost-effectiveness.
