A 42-year-old woman was sentenced to a suspended prison sentence for grievous bodily harm.

A neighbor dispute in the hallway had escalated.

Straußdorf/Ebersberg

– Two married couples living in the same house in Straußdorf had been at loggerheads for a long time.

A lost pair of shoes was the final straw.

Now a 42-year-old woman had to answer before the Ebersberg district court for insult and grievous bodily harm.

In December 2022, the woman, who now lives in Frauenneu-harting, is said to have suspected her neighbors of stealing her shoes from the common hallway.

She initially expressed her anger verbally.

While the neighbors were sitting comfortably over coffee in the winter garden, the defendant is said to have insulted the couple from the balcony of their apartment above with the words “Nazi bitch” and “Adams family”.

But that's not all: Shortly afterwards, the Frauenneuhartinger woman is said to have knocked on her neighbors' door and asked them to talk.

When the 46-year-old neighbor opened the apartment door, the defendant allegedly kicked her in the face.

The husband of the 46-year-old neighbor who rushed over tried to defuse the situation, but the defendant is said to have kicked him too - in the shin.

The woman is also said to have spit in her neighbor's face.

Mother of three rejects all accusations: It was exactly the other way around

The mother of three denied the allegations in court.

“I didn’t hit or spit on anyone,” she explained.

It happened exactly the other way around.

For months her neighbors threatened her, insulted her and set the dog on her.

On that December day, the neighboring couple finally ambushed her.

“I didn’t want to be provoked,” emphasized the defendant.

“But they attacked me.

I was just trying to free myself.” While her 41-year-old neighbor was holding her in a headlock, her neighbor and her brother are said to have hit her.

A doctor's report from the district clinic is said to confirm this, including photos of hematomas and scratches on the neck, arms and legs.

However, the witnesses invited were unable to confirm the defendant's version.

Not only the affected couple, but also other residents of the apartment building reported excessive alcohol consumption and sometimes aggressive behavior on the part of the woman from Neuharting.

“I'm afraid of her,” one witness testified in court.

The defendant had around two blood alcohol levels on the day of the crime

According to the police report, the defendant had around two per thousand in her blood on the day of the crime.

Since the woman also has a relevant criminal record, the public prosecutor saw the 42-year-old's excessive violence as confirmed.

He demanded a fine of 1,000 euros and a nine-month prison sentence, although “it is difficult for me to suspend it,” he said.

The defense, meanwhile, spoke of agreed witness statements and called for acquittal.

Judge Frank Gellhaus ultimately sentenced the housewife to a seven-month suspended prison sentence and addiction counseling sessions at Caritas.

“Alcohol is a massive trigger point for them.

“Get this under control,” he warned in the reasons for the verdict.
