"I don't remember saying this", "I recognize the people in the photo, they had a beer but didn't participate in the fight", "I don't know who participated in the shoe fight" and "some were regular customers". Regarding Maimone's alleged murderer, Francesco Pio Valda, the witness, Giovanni Nacarlo, owner of the Agostino chalet, reported having seen him for the first time on the day of the argument, which broke out due to a stomp on a pair of designer sneakers.

The anti-mafia prosecutor Antonella Fratello preferred not to reveal the names of the witnesses called for the next hearing today, in the trial underway in Naples for the murder of the aspiring pizza chef Francesco Pio Maimone, killed by a 38 caliber pistol shot fired at the height of a dispute that broke out on the night between 19 and 20 March 2023 on the seafront in Naples. A decision probably dictated to prevent conditioning, given the precedents. In the last hearing, the examination of the first witness, the owner of one of the chalets where the events occurred, was characterized by several "I don't remember". The second witness, a colleague of his, did not even show up and the judge decided to order forced accompaniment. Today, during the hearing, precisely because of his omissive attitude, he was investigated for perjury. The judge ordered the assignment of a court-appointed lawyer. In the end the witness availed himself of the right not to respond and the Court of Assizes (president Cristiano) decided to transmit the documents to the public prosecutor. During the hearing the judge accepted the request to suspend the precautionary terms pending the transcription of the ballistic reports. The Scientific Police was also listened to: the witness agents confirmed that the 38 special caliber bullet that killed Maimone was exploded from a distance of approximately 15 meters and that the shot was not fired in the air. Photographic recognition and the report relating to the discovery of burnt shoe residue were also acquired. Finally, a calendar of the next hearings has been set: 17 April, and 8 and 14 May.
