Just a new label for an old plan? Local councilors don’t trust applicants

- The new owner of the house in Holzolling, where the Hafner bakery previously had a bakery and shop, wanted to set up a workers' dormitory with 17 beds on the ground floor of the building. The local council refused, whereupon the property owner withdrew his application. Now there will be two apartments instead. But the local councilors are suspicious and the majority again refused to give their consent at their most recent meeting.

Mayor Leonhard Wöhr (CSU) began by recalling the previous events. The planned workers' dormitory was rejected in March because, on the one hand, there were fears about the parking spaces, which would hardly be available on the small property, and, on the other hand, because of the expected unrest, which was not compatible with a residential area. So now there was a new application for a change of use. “It is striking that the plan is almost identical to the previous one,” stated Wöhr, “only the names are different.” The floor plans of the two apartments are the same on the plans and only the rooms that were previously designated as two-bed rooms now referred to as “Bedroom”, “Child 1”, “Child 2” or “Reading Room”.

The members of the building committee had therefore recommended that the consent not be granted because the only textual change would raise the suspicion that “the originally planned use as a workers' dormitory should be continued.”

That's how a majority of the local councilors saw it. “I think it's a strong point how the municipality's planning sovereignty is being handled here,” said Betty Mehrer (SPD) angrily. Philipp Eikerling (Greens) reported from the building committee that they had accepted the application with a shake of their heads. “Such audacity must not prevail,” he demanded.

Johannes Wieser (CSU), however, had a different opinion. “This is a normal planning application for two homes and it needs to be treated as such,” he said. If the use is different afterwards, then that would be illegal, but “we cannot interfere”. Albert Huber (UWG) saw it differently. The drawing shows that the applicant is up to something. You don't have to accept that. Anian Rutz (UWG) confirmed that “legally everything was okay” and that the district office could approve the application. “But then they also have to monitor usage,” he said.

Ultimately, the local councilors refused to give their consent for the two apartments against two votes. If the district office replaces this agreement, it should impose conditions that prevent any other use.
