Toni Leistner from the second division soccer team Hamburger SV does not want to accept his suspension for fighting with a fan so easily.
"We do not make an objection, we demand an oral hearing," said his lawyer Christoph Schickhardt the TV broadcaster Sky Sport News.
Schickhardt went on to say that one could not accept the judgment and wanted to discuss it verbally on site.
Leistner, summer access at HSV, had been banned by the judges of the German Football Association for five competitive games, two of them on probation.
The 30-year-old went into the stands after the cup game in Dresden (1: 4) and wrestled a spectator to the ground after he had insulted him.
According to Schickhardt, Leistner can speak of self-defense.
"If you take the overall emotional situation into account, I at least understand," he added in "Bild am Sonntag".
DFB judge Hans E. Lorenz pointed out that he had already considered mitigating circumstances for Leistner because of the insults and the previous cup failure of the HSV.
But he also said: "The assault by a player on a spectator is a serious incident. It cannot end in an acquittal."
Last Friday, Leistner missed HSV's 2-1 win at the season opener against Fortuna Düsseldorf.
His probation period ends on September 18, 2021, the DFB had announced.
If the verdict remained, Leistner would still miss the games in Paderborn and against Aue.
"I have a significant reduction in mind. I may also apply for an acquittal. That is only due to the course of the main hearing, the hearing, the witnesses, what is the legal opinion of those involved. So in the end it will be a fair, a better one Verdict, "said Schickhardt.
