We're not cheating the diesel customers with the compensation, according to VW. Consumer advocates simply cannot believe that. The most important question: When is an offer a good offer?

Wolfsburg (dpa) - The chief lawyer from Volkswagen has guaranteed diesel customers a fair offer of compensation in the model suit. VW legal adviser Manfred Döss told the German press agency about corresponding demands from consumer protection groups: "I share the view that the settlement process must be made transparent and independently monitored."

This was requested by the head of the federal consumer association, Klaus Müller, after the negotiations with VW over an out-of-court solution in the dispute over compensation for diesel owners failed surprisingly last Friday.

Döss emphasized: "After all, we want the customer to accept the offer if he has decided for himself that it is right for him." The system for processing is to be available from the end of March. "We will set up an IT solution in which the customer can enter core data such as vehicle identification number and other information from the registration papers. Then he will receive an offer tailored to his personal situation," said Döss.

The calculation of the sum should be staggered according to the date of purchase of the car between 2008 and 2015 and a total of nine different vehicle classes with the diesel engine in question. VW wants to provide a total of up to 830 million euros. Depending on the individual case, customers should receive between 1350 and 6257 euros.

"We will of course disclose to consumers how much money there is for which vehicle," explained Döss. "Then the customer can decide whether to accept the one-time payment offer or to wait until one day the model declaratory action is completed and he then carries out his individual suit with an uncertain outcome." The model suit continues in parallel. Theoretically, diesel drivers who do not accept the VW offer could also receive higher compensation. However, this is uncertain.

The consumer advocates initially did not want to evaluate VW's offer due to the lack of details: "Since each case is individual, no general recommendation will be given." In any case, consumers should carefully consider what is on offer and weigh up their options. Previous comparisons would have brought on average compensation sums of around 15 percent of the purchase price.

"But it always depends on the overall package," emphasized the association. It is also about which rights would be assigned and when. A general waiver, which also includes future claims, is problematic. The consumer advocates also asked VW to treat the diesel drivers fairly and to give them sufficient time to consider the offer.
